Car accident
Hi i was involved in a minor car accident back in october 2016,it turn out my insurance had been cancelled,the other driver was not very plesent.Cutting a long story short I ended up in court but managed to argue special reasons and did not get any points or fine for not having insurance.
However I received a from diamond who are under the same umbrella of insurance you i was previously with saying their going to court to get their money back for repairs,I personally dont think i was to blame at least not solely but their going to try twist things I know.It turns out their going to try recover from MIB motor insurance bureu
I was just wondering if anyone had any advice I have been putting some money aside recently as I had a premonition that I was going to hear something this month I will continue to try keep my credit file clear just in case i need a loan.Has anyone got any advice that might help me as to how I can deal with the situation.

If you really thought you wasn't to blame then why not go to your own no win no fee solicitor and put your own claim in. These day's it's not about who is in the right or wrong but about who can put the best case together.

If you weren't covered, why did they pay for repairs?
If you can prove they paid while knowing they didn't have to they're stuck.

If possible I would like to just solve the matter asap even if I don`t think its 100 percent fair,although I guess il consider a no win no fee solicitor.Its a strange one I took Admiral which is the same as diamond to the ombudsman so I think they must have know I did`nt have cover.
I guess i`m wonder mainly if their will be a chance for me being able to just make an offer early on to just end the matter,it does seem rather strange though its taken them 13 months to act.

Oh i see - silly me! It's the other guy's insurers who are claiming against you.
If they're claiming from the MIB why they bothering you? Do they need a signature or something?
You could always ask them to send you a bill and then pay with a promissory note or maybe even A4V endorsement (not sure about that though).
If you want to try that you have some serious studying to do, with no guarantees.......

They claimed i needed to send them a summary of my driving licence,I don`t have any record of them sending my any correspondence though,hence I never sent them it.

They would of had to of sent you a refund of the money you had paid if they cancelled your cover.

Strange after going throw my papers iv now found an insurance certificate from hastings for cover for that year,all a bit strange.

Insurers will pay out knowing they can claim it back from the Motor Insurance Bureau, more importantly, why did they cancel the insurance in the first place and not notify the insured party?

There is something called inadvertent cover where by if you had insurance and you didn't disclose something then have an accident that they have to look at it and you have to pay the extra that it would of cost if you did did disclose the information. I'm not very good at explaining things but if you had your insurance, (which by all rights you should have of if they didn't refund your premium until 2 months after the accident) then the insurance can't refuse to pay they should only make you pay the difference of what the premium would of been.
