Regarding bailiffs & should you be unfortunate to have them in your home & the problem of stating what you own & don't own & prooving this has anyone thought of going to a solicitors & doing a sworn affidavit to state they you own 'nothing' in that home therefore they have no right to remove any property whatsoever (note also any vehicle is not owned by either you is it - you are the 'keeper' not owner). I know removing Implied Right of Access is a route but how often is this broken & other criminal gangs such as the police turn up & assist a crime.

My line of thinking was that if this is presented to said bailiffs (also any police present) it is a statement of truth & should they take anything you then have lawfull redress, this i would believe work & if stated on your sworn affidavit basically all you own is the clothes on your back then no items can be removed.

Any thoughts on this, has anyone tried this route as to my knowledge a sworn affidavit is a very powerful document?

I added a similar statement to the last debt purchaser i was involved with.
The reply i received was "We consider this account to be uninforceable" whether it was the contents of the final notice of the 3 letters ,this statement or a combination of both I do not know.

As an alternative to a Solicitor you just provide a sale agreement & receipt from a family member/trusted friend.
if it sold its not yours.
Or create a trust.

Any such action MUST predate any bailiff involvement.

You can also do this in a tripartate form and all you need are three people to witness the signature, no solicitors or fees involved.

Yes i meant to add that, clearly once you get wind that this route (bailiffs) are to be used do the above to stop their actions.

How would that be done exactly, you state in writing with family member/trusted friend that you sold them everything??

Yes just an invoice & receipt. A normal sales transaction.

I would add the following in the sales agreement to include " All items ,Goods ,Property and objects in or upon the land known as (add address).

As I understand these things, the courts can undo any transaction in the last 12 months if they consider the prupose of the transaction was the evade or pervert the course of justice.

Suggest checking the law for this.
