I have read some of your posts and need some advice.

I have posted before but I know the DCA are monitoring this site.

I need advice on a disputed debt for a BTL property. Please excuse the long description I have tried to keep this as short as possible. please read to the end.

The background in 2007 I bought in to a property investment company where I paid £3000 to them and they would help me invest in a property before it comes on to the market for a better price than the market value, which they would manage for two years and after two years I had the option to continue using their management, sell the property or use some other letting management company. They used their on solicitors and were also the mortgage broker. The valuation received, was a basic valuation and was for the mortgage lender Wave Lending, the valuation showed the property to be worth 220K with rental of 1200/month. Before purchasing the property I did visit the property to view but was not shown the actual property but a property in the same block and was told the tenant is not at the property and they did not have access to the property. I was shown a different property and was told this is exactly the same as the one I will be purchasing.

After completing the purchase in Dec 2007, there were problems receiving the rent from the management company and when I would inquire they would say they were having cash flow problems, This went on for 8 months after which the company disappeared. I was not receiving any rents and went to the property and talk to the tenant, at first the tenant did not believe me and after proving that I was the landlord I asked the tenant to pay me directly. This was the first time I saw the property and it was half the size as the property I was shown , I was being paid rent of 1200/month but the tenant told me they were only paying 600/month. This is when alarm bells started to go off in my head.

I asked a local estate agent to give me a valuation with a view to sell and they told me the property was worth 150K. I could not make the mortgage payments of 1000/month and got in touch with the police and reported this, the police told me this is a civil case and I should get legal advice from a solicitor. I instructed a solicitor to investigate the management company, the conveyancing solicitor and the surveyor. The solicitor's findings showed that the management company's directors had left the country, the conveyancing solicitor was acting for both the seller and myself, where the seller had purchased the property for 170K and on the same day sold this on to me for 220K. The lenders surveyor who overvalued the property was reported to the mortgage lender and the information about the conveyancing solicitor was also reported back to the mortgage lender. We tried to make a claim against the conveyancing solicitor indemnifying insurers, but the indemnifying insurers responded by saying that they will not cover fraudulent acts done knowingly. The solicitors were later struck off for other fraudulent activities.
I could not keep up with the mortgage repayments and stopped making payments in Nov 2008, I asked the lender to repossess the property, property was repossessed in June 2009. after repossession the property was sold for 129k , there is a short fall of 90k that I am being chased for. Wave lending then sold my account to Webb Resolutions in Feb 2010. Webb Resolution did pursue me for the debt via their solicitors Lapithus Servicing LLP, they stated that "your client signed a declaration which confirmed they have read and understood the notes relating to the valuation report under the solicitors valuation section . I will draw your attention to a key point within that section, "There may be serious defects in the property which are not revealed by the valuation report, or there may be omissions or inaccuracies in it, which do not matter to Wave, but should matter to you. It is important that you should not rely in any way on the valuation report prepared for wave in deciding whether to proceed with the purchase". As your client has legally agreed with the terms, conditions and disclaimers included within the original application before the loan was made in good faith I again state your clients claims do not impact on their liability to the mortgage. My solicitor explained to them "The original purchase price was on the basis that I had been informed the price was a genuine price and this was supported by both the evidence of the lender's surveyor and the fact that the lender was prepared to grant the loan. Had I been informed that the true market price was £100,000 less than I was paying and that this was a back to back transaction which accurately reflected the fact then I most certainly would not have proceeded with this purchase. There are serious concerns as to how the lender's surveyor was able to certify that I was paying a true market value price in the circumstances set out above."

In June 2016 the debt was sold on to TBI Financial services. I have explained to them the situation they just want me to admit the debt and pay the debt. I have asked for all documents and they have sent me copies, I don't think they have originals but I am not sure. They have an in-house solicitor which I have been dealing with but now they have sent this to a new solicitor Rippon, Patel and French. Who have been in touch with me asking me to make payment by the 14th March or they will issue court proceedings. Receive letter today stating they are now going to issue court proceedings.
I did a DSAR to the original lender and this shows that after the repossession they did a retro survey and this showed that the valuation came in at 100 - 150K . I did ask for a Deed of Assignment and they sent me a Deed of Confirmation, all this showed was my name and an account number I have posted this on here, I will find the link and send this to you.

i have been a victim, and not sure what to do. How do I tackle this, I trusted the conveyancing solicitor and did take in to consideration of the lenders surveyors valuation. I trusted these professionals and have been greatly let down. I am a house owner with three kids, our home has about 150k equity and I feel they will try to get CCJ on our home.

What kind of defence can I go to court with. I have never been to court . I feel there is a massive injustice being done here and it's driving my insane. How can I loose the fear and win against DCA.
