court letter

Hi all Im after advise, my partner has received a court letter for a credit card dept, we have sent the 3 letters and also requested contract information which would be impossible as nothing was ever signed, I guess we have to acknowledge the letter within 14 days, can we request the contract information from the court or will we have to ask the dept collectors for the information and any advise on how to create a defence case

when you say a court letter can you be more specific please is it a letter from the debt collector threatening court ? is it from a solicitor threatening court ? or has a claim actually been issued ?

a court summons ? who has summoned you to court ? and why have they summoned you ?

this is unusual for a credit card debt unless you have already had judgment against you are you sure this is not just a claim form from the bulk centre ?

Good Evening, have checked with my partner, its not a summons but a claim form from the County Court Business Centre, claimant PRA group, was after info as to what information we can ask for as part of our defence, we have gone through paper work and noted any discrepancies we have found, any assistance would be great

have you acknowledged service ? if not then they could get judgment by default .

Yes have acknowledged service, as gives us time to sort defence, do we have to send the documents in that we believe are wrong? also can we still request contracts etc as asked for in the 3 letters, thanks in advance

you need to request further information under part 18 of the CPR based on their particulars of claim

if you have not already done so then a CCA request is a must

from your posts so far i am clueless as to what you have requested or what you may have received so far from, i assume the debt buyer ?

more info is urgently needed as from our perspective there is nothing to go on.

the claim form will tell you who to write to for documents, it may be the claimant or their solicitor but NOT the court that would be a waste of time.

Looking at the dates the deadline for any defence must be fast approaching.

Have requested original contract, and all associated paper work, of which she has received a reconstituted document with incorrect details on it, some itemised paperwork, also letters stating they do not have to supply the original documents.
