I was on incapacity benefit income support & careers allowance, i relocated to a new county & was trying to get my own disability living allowance now pip. unfortunately the cab closed then i was unlawfully evicted 7 months later due to landlady/lords divorce having paid 1 years rent up front to secure & have peaceful tenancy so became homeless i lived in my car 13 months & due to loss of letters & not received was temporary put on system for esa or even jsa as thought fit for work or at work unsure as still got paid incapacity benefit but uncured dental bill debt?
Now in a home all benefits stopped sep 2016 i wrote to dwp dec jan feb i had to apply for universal credit i applied on line due to issues taking to long what with no internet, landline or mobile credit my disability they are aware of my situations. The dwp called me early march saying its was was urgent they know am unable to attend meet for face 2 face & after i requested home visit finally said yes, now say cant come due to my disability but would call me back 28 29 march latest, its now 8 wks past & nothing.
i am aware human right being violated what can i do as failed me & am on nil income having paid rent today come 1st july cant pay so will start eviction as told takes 8 wks from face 2 face to set up now paying full council tax when told them its in dispute still taken to court & no house benefit received so all rent paid as cant pay til universal cred is in place.
bear in mind am full time career carers benefit has stoped & there benefits ceased & housing benefit & council tax full & also taken to court, when i am the appointee & again told in dispute so both our names are mud & so two homes evicted as urgent.
so please can anyone as dyslexic its hard to write read all the time and its slow & am at a low as to how to get my entitlements who to write to, how to write, what stating as all new to this so need template which would help as no cab in my area even tho was no good advise so am on my own on this one as relocated to new county so all benefits changed so messing me with no support & them not paying so where to start as mark ceylon said write here any advise tips most welcome as in shit street in 4 wks & worried so under alarm and distress & wasn't sanctioned.
thanks in advance. do ask me if require more info quick response appreciated as 4 wks to do 8 wks stuff in but want £ now & can live & reinstigated & backdated as going to food banks as nil income, so no gas for hot water & cooking & a prepayment meter been trying to get out since been there 2 yrs & electric debt along with waters & nhs dental. so cant run our homes due to nil incomes & the situation they put us in & as no 3rd party support in area live so delays.
my original debts have risen i tried marks goodf site was told by Ben Moss from advance finance solutions they would consolidate all my debts and give a payment plan, i thought wrong so checked with mark he said i was right its the wrong answer from them so hence on here seeking what can do next and how to compile letters requiring our £ & getting rid of debt fraud too.

Hi MMM,

Sorry but its still very difficult to understand, Maybe if you could break it down in shorter sections.

Can you please list what benefits you were receiving before you relocated ?

What benefits have you now applied for ,and what response did you get to your applications.

I am sure we will all give whatever advise we can.

I was on income support, incapacity benefit & carers allownace i also got housing benefit & discounted council tax, when moved i was trying for my own disability living allowance benefit think now called pip. the cab closed & lived in car 13 mnths finally £ ceased sept 2016 was told apply for universal credits, which did january told was incomplete needed to do se me face to face there at jobcentre due to my disabilities unable & lack of internet, landline or mobile credit disaster applying they are aware of this i also requested so asked for home visit as no friends family support etc finally said ok will come to mine after several requests from me then called me & said cant come out due to my disabilities & would call me no later than 29th march 2017 had nothing from them am still carer & they get no benefits either. so 2 x council tax full & 2 x full rents now paid with nil income & debts even more & relations becoming estranged as loss & harm & human rights breached. under alarm & distress as 1 july rents due nil income eviction will happen too..

Hi MMM,
I have quickly put together something to send to your local DWPl regarding your benefit claim, also do something similar for DWP.
Please wait for others input & advise .
------------------------------------------------------------------------------------------------------------------NAME OF YOUR LOCAL DWP                                                                                              YOUR NAME
ADDRESS OF YOUR LOCAL DWP                                                                                           YOUR ADDRESS

Dear Sir/ Madam (or name of person you have been dealing with)

I am writing to you regarding my claim for benefits made on (date) To date my claim is still incomplete as i have severe disabilities and are unable to attend your offices in person.
I was informed by your office that you would attend a home visit ,this you have cancelled and i was informed that I would be contacted no later than the 29th March 2017 .To date you have failed to contact me .
As a result I am in a  position  of severe hardship & debt due to your lack of duty of care towards me.
I draw your attention to the Universal Declaration of Human Rights article 25 sec 1. To which the UK is a signatory.

Unless I receive confirmation from you within seven (7) days that my claim is being addressed .I will have no alternative but to seek the name of your employee who is responsible for the deliberate withholding my rights.

I require all future correspondence to be signed by a named individual who takes liability for its contents.

                                                                                                         yours sincerely   xxxxxxxxxxxx

----------------------------------------------------------------------------------------------------------------
That would be my response .See what other input you get from other members as i have had no dealings with DWP

council tax i put both mine & my sons in to dispute as both wrong on so many levels they ignored this so both taken to court both being charged full council tax as not getting benefits & housing benefit cant be paid until universal credit is paid so until paid expected to pay full council tax & all rent. i beleive same with trying dla/pip for son so all his council tax i pay & no housing benefit so all his rent to, council are aware nil income for us both so it been noted to them but rent to still be paid regardless of there council tax which is full amount for both as said held for now, but as said when disputed & asked not to take to court was ignored. so worried i used to get the £ for rent & pay landlord myself always have never a problem but with nothing from them financially due to lack of benefits now pay rent x 2 & council tax expect all but is on hold so hence debts & nil income.

You could try this for your Council Tax & housing benefit.

NAME OF COUNCIL                                                                YOUR NAME
ADDRESS OF COUNCIL                                                            YOUR ADDRESS

Dear (name if you know )

As you have been made aware of my disabilities and my zero income. Made even worse by your pursuit of me via your Court action in respect of Council Tax.You have failed in your duty of care to me and you have breached Article 25 section 1 of the Universal Convention on Human Rights to which the UK is a signatory and you have an obligation to uphold.

I now require from you the name of the individual from the Council who is responsible for making the decisions and takes liability regarding my claim.
Also you are aware that the Council has the discretion to reduce the level of Council Tax as far as zero.

Therefore also take this letter as a request under the Freedom of Information Act 2000 to supply the following information.

1.In years ending April 2016 and April 2017 ,How many Council Tax discretionary reductions did your Council make.
2. How many of these were  to 50% and below.
3. Also how many discretionary reductions did your Council make to zero any accounts.

I now require all future correspondence from your Council to be signed by a named individual who takes liability for its contents.

                                                                                                           yours sincerely

Hi all

Hi daveiron - good on you!

Hi MMM - good luck!

Hi SIASL - good grief! it seems to me that if civil servants could not be held liable then they wouldn't be so reluctant to sign their correspondence. Besides we're talking about negligence here. There's no need for a change in law to hold man to account, but if there was then Muto Propria ought to do it.
Can you think of anything that might help MMM?

Cheers!

Merriam-Webster's Dictionary of Law.
Definition of signature:

1a the act of signing one's name or of making a mark in lieu thereof
b.: the name of a person written with his or her own hand to signify that the writing which precedes accords with his or her wishes or intentions.
c: a mark (as initials, stamp,or printed name) made on a document and intended to serve as an indication of the party's execution or authentication of the document and INTENT TO BE BOUND BY IT.

Worth keeping a note of this legal definition regarding a signature .

Try Citizens Advice. CAB net/phone book.

You make an appt' and speak to them face to face.

Explain.

They will Telephone relevant people as you wait, you provide the security info on the same Phone.

Ie D.O.B etc, take your National Insurance number if you can't remember it.

Cost of the phone call is Expensive. Premium Rate. Ring them ONCE.

Leave a message and contact details on the answer M/C, they WILL ring back eventually.

They get more Loonies than GOODF ever did.
