ok you would avoid a CCJ but would end up paying them anyway just have to pay the added court costs ?

Ask that in a new post perhaps? It's a good question... I've been following GOODF for approx.6 years (old and new) and I still don't know for sure why.

Regardless, some of us have 'banded together' through a joint hatred of the scum that are debt companies and a joint desire to help people in need who are, in effect, being extorted out of money as for almost EVERY case, the debt companies do not have the appropriate financial instruments etc and (PATHETICALLY) rely on scare tactics - and that's it - to get people to pay.

OK thank you. We are currently working on trying to improve our hit score so to speak. Then again, when most people use your typical search engines (Google etc) these search engines are in no 'hurry' to point people to get out of debt free sites. I wonder why Wink

the claim form gives me the particulars so that is enough

since the claim what have you asked them for ?

what have they provided as evidence ? is the agreement genuine ?

also i would like if possible to see what was in your defence ?

i have enough information from what you have sent to see what has happened in respect of the claim and defence,

you do have a strong case for defending this but to be brutally honest your defence is almost non existent to raising winnable arguments in respect of their actual claim.

If you do not mention certain things in your defence then the judge can refuse they be brought up at any final hearing, the advantage you do have is that no documentary evidence had been provided prior to you submitting the defence ( providing this is in fact true ) if they can evidence they sent you the documents prior to issuing the claim then you are going to struggle.
the letter they sent you listing what they had provided does it pre date the claim form ?

also what have you requested from them since they issued the claim ?

I think only the original "true copy"of the credit agreement plus deed of assignment,which I understand they dont have to provide anyway and the deed of novation

well they have sent you a copy of the agreement ( signed )

there will be no deed of novation

the deed of assignment is very very difficult to get hold of, but you have not given any reasonable argument as to why they must or need to provide a copy, just said they haven't provided it.

i have to be honest, its the best way to be : if they did provide the agreement before the claim then your defence is not true which is not good and will p*ss off any judge and will result in them treating you like another 'debt avoider'

this has progressed quite a way now and also gone past mediation, it is still not a lost cause and there are many things you could do to win this but would take a lot of time and effort and also understanding of the consumer credit act.

i simply would not have the time to do it for you, although i don't like to say this your best bet would be to instruct a solicitor who specialises in such cases because it is a winnable case.

i am just being honest with you on this .
