Council Tax Summons
Hi all I am new to this forum.
I have received a summons for unpaid council tax with costs added. It says I am summoned to a remote audio hearing via telephone!!!
So how am I legally able to challenge this?
Can I defend on the basis that the defendant is a fictional entity or is not actually in court?
It says if The defendant doesn't attend then a liability order WILL be granted in their absence??
Interestingly the name on the summons is NOT in capitals???

Hi & welcome,
You are far too late with this now,in any event CT and court is little more than a scam.
Its more than likely the liability order will already be signed before any hearing.
The only advice i can offer at this stage is to contact the council and make an
arrangement with them,only agree to what you can afford.
A solution for next year however may well be found At the Universal Law
Community Trust .It takes a bit to get your head around it ,so you will need to
spend time on it .It can i believe be used for much more than CT.

According to the letter I have to pay in full to stop the liability order from being granted.
Are they referring to what is know as a CCJ that would be recorded on my credit file?

It depends on how much importance you place on your credit file.
i would suggest you write to them informing them you are not refusing to pay
& you require them to agree a payment plan.Court is for disputes ,you are offering
to pay ,therefor there is no dispute. In any event they will have to accept a
payment plan that you can afford & that is what the court would direct in any event.
The video is something you may want to try next year ,but i would suggest research
first.

Look again at the correspondence, the council has issued a summons, only a court can issue a summons and no council can so this is actually fraud according to Halsburys Law.
Watch, and understand "The Greatest Showman" above and it becomes clear, from there you can challenge the council issued summons which you will find is illegal and an act based upon an illegal act is itself null and void.
