Should I give up my quest to find a Public Notary?

Should I give up my quest to find a Public Notary? Empty Should I give up my quest to find a Public Notary?

Post by Highlander72 Mon Apr 26, 2021 2:33 pm

When I do a search on duckduckgo, I can only find the details of Notary Publics, who advertise their services and some terms of business online. It seems that the very corrupt system that they are commissioned by, is the same system that encourages them not to notarise documents deemed too controversial.

My question is, have I embarked on a wild goose chase? Is a Public Notory and a Notary Public one in the same person, acting in different capacities, as the post below seems to suggest?

If anyone out there knows where I can locate one in the London area, please let me know.

Or should we even use them to "validate" our documents to satisfy the requirements of a different jurisdiction and a system that is almost entirely unlawful anyway? Will 2 or 3 witnesses suffice instead?

Read the Bills of exchange act - section 94

This tells you that in the event of no notary two good men will do, I prefer 3 good men.

Why 3? because everything under Mosaic law is in tripartite form of 3s or multiples of 3.

However, if you make yourself the postmaster with the correct paperwork a stamp and signature make you the notary so you self notarise your own documents.

Notary publics operate under Ecclisiastic law (Canon Law) which is the law of the church or Church Canons and their only function is to witness your signature, hence why you sign in front of them. In many cases they read your documents and are refusing to sign many which they see as contentious, they have been instructed to do this by the church and are breaching their own rules and ethics as your private business is your private business and not theirs.

Any solicitor can notarise a document for you.  If that won't do for who ever is requiring this, then there are people called "Notaries" (not quite the same as the US Public Notary).  You can find one here ..

Incorrect, solicitors cannot notarize a document as this is done under ecclisiastical law and only notaries who are approved can do this, solicitors can only act as a witness to say they witnessed the signature and supply an affidavit of truth which is nowhere as powerful as a notarized document.

It depends what you mean, and as often the case it's important not to be confused by US terminology.  If by "notarised" you mean signed by a notary then of course you're correct and maybe I was wrong to use that term, although is routinely used in that way in the UK for example guidance stating "You should first have your document notarised by a Notary or solicitor"

However all practising solicitors are authorised to act as a Commissioner for Oaths, which is very different from just being a witness.  As such they administer the oath for documents that must be sworn before signature, and verify the identity of the deponent.  This what is needed for pretty much any legal process within the UK.  In fact I'd be interested if anyone has an actual example where a document administered this way was not accepted.

The principle difference is that Notaries can administer this process for documents originating or to be used around the world, and have a degree of duty to ensure that the deponent understands the content of the document.  Even so it may not be required for all overseas processes, but tends to be only the more complex.  This may be why they are declining the OP's request.

So the advice for the OP would depend on what the document actually is, which has not been stated.  The suggestion that simply having it witnessed is "just as good" would be incorrect if it is actually a legal document.
