Hi All,

Been fighting these f*ckers with previous website's help for my other half and now is my turn to fight for myself.
Haven't been in the game for a couple years, so took adventure to start new approach 3 letter (notice) way.

Attached PRA group response to my 1st letter with NoCA. I actually use the same photo copy files from other topic that I found on this forum (as it is just a template letter from them, isn't?). But as there was no advise given how to respond to this letter I decided to call for help.  

Shall I just go ahead with 2nd letter? 2nd letter (NoCA) says: "As of the date of this Notice you have placed yourself in dishonour by your non
response."
Got confused, because they responded and state that they have contacted the OC for a copy of the requested documentation.

Any guidelines will be much appreciated!

It shows that all they have is a list of defaulted accounts ,no documents
to substanciate their claim. note they have responded with a 'without predudice'
letter. continue to notice 2. The sensitive info reference is BS as the notice clearly
states you will accept a copy with redactions for third party information.

Yes you are right about BS.
If they had a ligitmate claim ,your NoCA would have them dancing for joy.
All they would need to get paid is the original agreement,which they clearly
do not hold or have ever seen. "Holder in due course"

I have prepared an intro letter for 2nd NoCA.

"I am in receipt of your letter dated 3rd November 2021 and received 9th November 2021.

In first paragraph of this letter you are writing: “You appear to be suggesting in your letter that in your opinion, the application of certain legislation or common law principles has the effect of extinguishing your obligation to pay this debt.”
I request you to justify what have made you to come up with such assumption.

My previous letter clearly state that I am concerned that I owe a debt to your corporation, not that I don’t have obligation to pay this debt. To prove your claim I request you to answer to all and every 10 points in the following Notice of Conditional Acceptance in the form of an affidavit, made under full personal liability and under penalty of perjury, by the deponent who has the authority to bind the company in contract.

Regards to sensitive commercial information which is included within Deed of Assignment and Deed of Novation, I already told you that I am prepared to accept a redacted copy.


I refer you to my Notice of Conditional Acceptance."



Could you please have a look and suggest if any amendments needed.

Not sure about wording "To prove your claim". What would be the best substitutional word for "prove"?

Ok ,try proof of claim. also its important to always refer to alleged debt
it avoids any implied admission.
Of course you dont need to send this letter at all.just the next notice,
but change the wording to You are in dishonour by your failure to address the
specific questions asked,in order that i may settle any lawful obligation i may
have.

When I send 2nd letter, which state that NoCA is attached. Do I need sign both: letter and NoCA?

Letter 2 is the NoCA. Just as letter 1 would be and letter 3 would be. You don't write a letter and attach a NoCA. The NoCA IS the letter*.

*Technically speaking, you are not sending a letter, you are sending a NOTICE. And therefor from a legal point of view, this has greater ramifications for the claimant i.e. they must take it much more seriously.
