Somone I know let into her home a tv licensing goon who said he was a bbc employee

She agreed a payment plan with him. They then increased her agreed installments without notice so she stopped paying.

So they sent her a 'court fine' with a 'victim surcharge'  jocolor

Anything she can do about not paying any of it?

Sounds like she already has the experience & has learnt, so carry on as is, after all the GBP - '£' is fake & worthless any way. Why do these people want an amount of nothing?

TV licensing is treated as criminal, a bit like road traffic matters but without the options for courses or even fixed penalties. So to reach the fine stage there must have been a Magistrate Court conviction.

Did she receive advance notice? Probably a Single Justice Procedure Notice, but it's possible some regions still use the old Summons. If she didn't receive this, and the fine was the first that she heard then she can do a Statutory Declaration to get the conviction removed.  This would give the opportunity to defend, provide information to minimise the fine, or pay by instalments.

The fine of £220 suggests it was based on the default weekly income of £440. She may be able to get this reduced after the SD, firstly if her weekly income is less that £440 and secondly by receiving a discount for guilty plea.

Strictly she has the automatic right of appeal to the Crown Court, but would have to be confident of her defence and of handling herself in court for her to even consider this.

No idea how she wants to play this, so just setting out some of the options.

Don't trust the Crown Court as this is the same company of HMCTS and the crown courts, magistrates courts, and tribunals are part of the same company which have extracted cash then why would they overturn their decision when all they have is a District Judge who is also an employee of HMCTS accompanied by two magistrates so guaranteed nepotism.

Much better going to the Court of Appeal as they will be impartial and have the power of the High Court which is way above that of a crown court.

I think we need to know exactly what's happened so far, and the dates, as these will determine the options available. For example an SD isn't an option if the SJPN was returned, or if we are now out of time.

I have never seen documentation on direct path from Magistrates to Court of Appeal, are you sure it doesn't have to be appealed to Crown Court first?

No it doesn't and as the Court of Appeal is a division of the High Court anyone has access to it and the only reason they wan't you to go to a Crown Court is money, Magistrates and Crown Courts are part of the private company called HMCTS based in Staffordshire on a farm and yes I have been there. Magistrates courts and their system tells you that you have to appeal via their system and the law says something different and if magistrates courts are appealed in a crown court appeals system you get something called a district judge and two magistrates and this is to give al illusion of justice and nothing else apart from money and illusions, magistrates judging magistrates says it all especially when they are from the same circuit as often they know each other, and a judge appointed by the same company who finds against you, no justice will be done but we can lighten your wallet.

If you suspect justice will not be done you apply to the Court of Appeal and state your reasoning based upon evidence and why they got the decision wrong in the first place and if you cite precedents and case law to show why they got it wrong followed by nepotism and equitable interests the COA will hear the case.
