Case Stayed Then Unstayed Because Of Backlog at CCBC

Hi all, been a while, hope everyone havong a good start to 2023...

wondered if anyone had any thoughts on this...

Claim brought by Overdales for Lowells against me at end of last year (2022) for alleged unpaid BT bill from 2019. Claim defended as no knowledge of alleged debt, sent BT an SAR, to which they sent back very little (name, address, no account number, no content). Overdales 'missed' their 28 days (around about 14th January) to move forward, and it got stayed. low and behold today, a letter from CCBC with a DIrections Questionairre and looking on moneyclaim sure enough, stay lifted on 1st February.

I rang up CCBC to ask to see Judges Order (not sure if that it correct term, but I believe they have to apply for an Order to have case Un-Stayed?) and if they had paid fee to do this. First told yes to both... then after being put on hold for 10 minutes, lady came back and said 'Oh we have lifted the Stay as Overdales emailed us before 28 days was up (13th January) and we have a backlog here, so we just lifted the stay on 1st Feb...'
I did ask if that was correct procedure and let them know I would like to see evidence of all that... she got a bit shirty and CCBC lady insists I email them and they will reply with 'evidence'.

Drafting that email now...

So, does this sound normal procedure? Can CCBC lift a Stay just like that? Any thoughts appreciated.

this is not really normal but typical of what is going on with CCBC, i have had many problems with them recently. The issue they had and probably still have is that they are so far behind on opening e mails !! they were 4 weeks behind back in september ! so what i think has happened here is that overdales have e mailed the day before the deadline stating they wish to continue and CCBC haven't even opened the e mail they have then stayed the claim because of no response from overdales, overdales have probably complained so CCBC have reversed their original decision having now seen the e mail

but you are right to ask for evidence.

i have not seen anything regarding this case or claim so cant comment further.

Its a bulk cente calling itself the business centre and is merely a business or administrative funcrion and there are no judges orders as they have no judges there and they are not attached or connected in any way to the County Court which is in a different location and want nothing to do with the business centre.
