If a Scottish DCA buys a English loan , what law is applicable. As there is a difference in length of time on when a loan is statute barred in Scotland .

That's a tough one. I suspect English, unless you're resident in Scotlnd.

Sale of the debt can't change the governing law in the original contract. In terms of procedure, if the customer is resident in England then that's where any case would have to be raised.

it will be english ?

when an american vulture fund buys uk mortgage and business debt it doesnt suddenly become american law ?

check the agreement and T & C's and you will find within it states this contract is governed by the laws of england and wales.

it would be a good idea for members to read any terms and conditions they have, you can learn a lot from them.

By the way, a DCA (debt COLLECTION agency) isn’t a purchaser of an alleged debt. It acts on (attempts to collect on) behalf of a debt purchaser (DP).
