Hi does the OFT guidelines no longer exist? I saw a quote recently from it showing how a DCA cannot send letters to the Occupier.

Either way, is it illegal for them to pursue the Occupier. I am pretty sure you can't take the Occupier to court or issue a CCJ against Occupier. Am I right?

lets be very clear here, when the cestue qui vie trust is formed it is only based upon the name and it is the name which is registered and EVERYTHING revolves around the name as this is an individualls unigue reference number, your number plate if you like and anything sent to "the occupier" is delivered to the wrong address and should be returned unopened.

If someone at an address had the name Occupier it then needs a title such as Mr Occupier, Mrs Occupier and so on.

You cannot get a CCJ against "The Occupier" as it needs the name and a title, if Mr Watson takes out a loan and fails to repay it they then need the title of Mr so it identifies the individual the CCJ is against as you could have Mrs Watson, Master Watson and even Miss Watson at the same address and none of these have anything to with the CCJ and if the CCJ is totally unspecific in identifyinf the individual the law (real law) says it has no voracity.
