Real Crime

Hi All,
Just wondered what the members would advise if you were indeed a victim of real crime? Would one involve the Pole Ice? I would rather not as I have tried this route unsuccessfully in the past.
See I opened my gate this morning only to be nearly mowed down by an oncoming Volvo that had mounted the kerb to get by some parked cars this was a school run mum & by the time I had gathered myself (missed me by inches) she had sped off, I have looked at Section 72 of the highways Act 1835(see below) and it seems pretty black and white but loathe to get the old bill involved, as they are worse that useless!

Rule 145: "You MUST NOT drive on or over a pavement, footpath or bridleway except to gain lawful access to property, or in the case of an emergency." (The offence of driving on a bridleway is covered by a later act) Rule 157: "[A non-road legal] vehicle MUST NOT be used on roads, pavements, footpaths or bridleways."

If she is on the school run,have a word with her & if no apology is forthcoming ,start filming her daily .

If you have tried reporting it to the police and they have refused to investigate then report them to the chief constable, in writing, and ask the chief constable to act as by their very name they are a constable and the chief of the constables, and therefore liable.

See what response you get and if it is a fob you off response then look at the local media as they often love such stories, and this will raise awareness of the problem and in many cases it will force them to react.

You have an MP, write to them along with Amber Rudd whose Ministerial department the police fall under, you have a clear criminal offence, a description of a vehicle and driver, and you know they are on the school run, write to your MP and C.C. Amber Rudd and the media will take a keen interest.

By making a formal complaint you then have the option to bring a civil claim against the chief constable.
