Hope you're well.
Fine thanks How are you?
Wynston.adebiyi@gmail.com wrote:Each time a bill is issued, a trust is created. Three are 3 components to the creation of said trusts; settlor, drawee and the beneficiary.
Correct
Wynston.adebiyi@gmail.com wrote:The utility company retains its position as both settlor and beneficiary.
yes & no
Wynston.adebiyi@gmail.com wrote:Quite complicated from what I read...
The initial Trust created is done when handing the name (yours) over.

1. The Trust is actually hidden & not disclosed as far am concerned. Proving it is difficult & to claim it exists it has to be proven, without proof there is no Trust

Settlor - you, me & everyone else that deals with util Cos.
Trustee - Util Co.
Benificary - all of us get to heat, wash, cook etc. Util Co too, they receive from us 'payment' to discharge thier charge.

2. When receiving a bill that is a Trust in itself as described in those links I gave.

3. depending on what you do next when returning said, bill another Trust comes into play. If you A4V (own instrument) or you endorse (using different wording its essentially the same thing) & the tear off slip (ts).

At most I think there are possibly 4 Trusts.

Trusts 1. the initial created. 2. the bill. 3. how you reply to said bill - 3a with the ts given (endorsement/A4V). 3b full A4V with your own newly created instrument (copy of said bill because it has 'value')

if you use cash/cheque to discharge said bill there are only 2 Trusts as you will have admitted you are the Trustee in that case to Trust No 2 with No 1 still hidden

You can A4V using the ts by writing the A4V wording & stating 'Exemption ID:' instead of NINO, write - 'use the information contained below on the tear off slip' because HMRC did issue a bulletin  - effect "we don't hold any accounts to discharge debts"

Remember its the action of receiving the bill & knowing what to do next is proving a Trust in No 3 above

A4V in itself is not a Trust (that's simply stating an acceptance), the instrument itself is the Trust.

Just simply mind boggling. So when the bgc is received the individual dealing with it has an understanding of these trusts and will be placing the burden of proof on me to demonstrate my knowledge that this dynamic exists?

which ever method you choose, A4V or endorse (if its what you want?) write said wording on document in the correct way, pop paperwork into envelope & post via recorded delivery through royal mail. Simple?

if you choose cash/cheque that's your choice alone. its the same for us all.

Thanks LS. I would be grateful for your advise on this....the notice of conditional acceptance/ 3 letter process. The utility company proving a contract exists. Is thus something that you are familiar with?

Forget any of that there is NO contract its simply 'deemed'.

Obviously no one can deem anything over anyone else but because of the b'cert - 'A CERTIFICATE IS NOT EVIDENCE OF IDENTITY' & "Crown copyright". All  have been running around 'my name is....' we are all using a company we do not own & accept liability for.

So to reiterate do NOT ask for contract it don't exist. Forget 3 letter process in this case, same for c'tax - its a 'DEMAND' if you like Dick Turpin - 'stand deliver' its theft & nowt else.

'from down memory lane', Wesly Ahmed video - this is endorsement
https://www.youtube.com/watch?v=A73YJn42fGM

A4V take your pick:
https://www.youtube.com/results?search_query=a4v

the US versions - do NOT put HM treasury for here in UK, use as directed in:
https://goodf.forumotion.com/t6055-more-on-tear-off-slips-trusts

the bit that starts:
exact wording (please note the colors used):
*******************************************************************************************

& remember that stated above over 'Exemption ID' wording.

follow the Wesley Ahmed vid mentioned above for the wording to go on the back of the tear off slip. Then use the covering letter as mentioned

Thanks LS. Been watching the video links you posted. The American one detailing the Bond/Coupon is quite informative and correlates with the trusts we discussed earlier.

I was going through some of the comments on the Wesley Ahmed video and cane across what I thought was an interesting one....the commenter stated that the reason why people are getting knocked back is because they are sending the instrument back to the energy company whereas its meant to be forwarded to HM treasury with a copy to HMRC and if needed, the energy company. ....?

Thought it was an interesting idea...

something I want to make absolutly CLEAR, whilst I can help fight against this with legislation (to a point) you must remember EVERYTHING gets IGNORED. So if you are clear to yourself this is what you want to do then go for it. But you will ATM not get the stalemate sought. You may get 'bailiffs' at your door but you will get 'court paperwork' with a so called 'signature' that they will not show/state we don't have to.... etc & ultimately get forced entry to fit pre pay & you end up on a much higher tariff - penilised for being poor (as its seen).

This will not end well. The choice is yours & yours alone to make as it is for all.

To avoid harrasment use cash/cheque it will temporarily make things go away until the next....
