Howard Cohen & Robinson Way

Hi,

I read your post regarding Howard Cohen solicitors and Robinson Way/Hoist. I sent Howard Cohen the letter and received a copy of a letter from barclaycard saying they have assigned the account to Robinson Way, also a notice of assignment from hoist and a pretty poor statement.

They replied that they will contact hoist for further paperwork.

I Was wondering how you think I should proceed? I am tempted to sent rob way the 3 letters but am unsure.

your advice would be much appreciated

Hi,

1.) What type of debt was this from Barclaycard? Credit Card? Loan? Overdraft etc? And how much (just round UP to the nearest £k)

2) Who owns the actual debt? Robinson Way or Hoist?

3) You said you sent a letter. What letter? One of the GOODF template letters? If so, which one? Letter 1, 2 or 3?

Hi, this was barclaycard debt for £3,500 from 2000 defaulted in 2016

Im not sure, according to HC letter its Hoist

the letter I sent was the one "in addition to 3 letter"

Did I not, apologies it was credit card. I did the 3 letters with barclaycard a few years ago and all went quiet then this arrived the other day.

have just a couple of questions

1) copy of a letter from barclaycard assigning the account to robinson way ?

2) a notice of assignment from hoist ? saying what ?

2 companies here who is the assignee ? doesnt make sense. unless this has been reassigned ?

was this originally a barclaycard account ? or one of the companies barclaycard bought out ?

Hi again, hope you are well.

I received a letter back from hoist finance saying they could not obtain the necessary paperwork to resolve my dispute. which I assume means it is thus unenforceable, but give me 14 days before writing to me again. if I can work out how to upload pics I will attach letter.

Also and before you go any further, it is essential that you read the following link to the recently REVISED GOODF Process and Templates. It will ensure you fully understand the latest approach and what is involved, and will therefore increase your chances of success including avoiding the courts. Simple copying and pasting of templates is extremely unlikely to work.

And most importantly: properly understanding and following the GOODF process also helps us to help you going forward...

the assignment is from hoist stating that barclaycard have transferred their the alleged debt to them and accompanied by a letter from barclaycard

I would like to say that I wish to thank everyone who offers their assistance on here. I am sorry for my gaffes, I don't mean to breach etiquette, but do find the forum a little confusing. Im sure I will get the hang of it so thankyou for your patience. Do you require any further info? I thought I had uploaded a letter which I sent to Howard Cohen, but it isn't showing.

referring to the letter I received from Hoist it appears that they have no documentation. does this mean its as good as over? I don't understand why they say they will contact me again in 14 days if they cannot provide proof of debt.

One thing I should add is that I haven't sent the 3 letters to hoist. I did to barclaycard and am considering sending letter 1 to hoist.

Robinson way wrote to me in June 2020, this was followed by Howard Cohen in September in which they stated they were acting on behalf of hoist. I replied to hc with letter asking for proof of debt. (I can upload if you like) and I just received this letter from hoist themselves.

Hoist is what we call a Debt Purchaser NOT a Debt Collection Agency (DCA). Both Robinson Way and Howard Cohen have both acted as DCAs in your situation.

And now you are back to Hoist for whatever reason.

Now that you know Hoist is a Debt Purchaser, and once you read the above post (and the link the above post refers to) you'll know EXACTLY what to do next / which exact template letter to send.

It really is as simple as that and I can't make it any more simple I'm afraid / this will have to be my last post for the weekend as I cannot justify to my family etc spending any longer on this Smile

I came home to the letter below,This was their response after letter 3. letter 3 was dated 12th march and their response is obviously dated 24th. what suggestions do you have for my next step?

you received a letter dated 10th feb stating that they were unable to obtain the documents requested so that would stall them.

you have received a letter dated 24th march stating they are looking into your enquiry ? what enquiry might that refer to ?

Probably the usual case of a debt purchaser / debt collection agent getting tangled up / being incoherent / sending their own template responses no doubt. I have lost count of the DPs and DCAs I've dealt with in the past and not one of them corresponds correctly i.e. point by point in-line with the points we raise.
