I am sure members have noticed the growing trend of claims on accounts that are within a few months of being Statute Barred,

In the effort to keep ahead of the parasites .It would be very helpful if all members in this position were to give full feedback.

Ie; letters sent / received.If it ended up in Court,what questions were asked & answers given etc. As much detail as possible please ( remembering to redact personal details of course).

If however you feel you may have messed something up along the way,please do not worry about posting it.You will not be criticized here. We are all in this together and the aim is to help each other.

Hi,

I've got a question. I was forced to take a loan with DWP back in 2009, it wasn't much. The DWP did take the payments from the JSA.

I was under impression that it was paid.

Last week I've received a letter from DWP that I owe them still some money, so I asked them for a signed letter with all the details.

It came this week. There is a full name but no signature.
I know it is only over £40, but just the fact that it is from 2009 and nobody was chasing anything is a little bit strange.

Is this Statute Barred?

Please advise,

I would ask for clarification & why was it not taken with the other payments .
If it was their error ,you have no debt .

Right, if it is statute barred then they can claim it back only with YOUR CONSENT but in reality what is happening is different departments look at it and act fraudulently with a lot of creaive accounting and they were actually caught out about 4 years ago with this practice which is illegal and unlawful.

What happened was simple, they employed several slippery people with dodgy backgrounds who created fabricated debts on the basis if deliberately falsifying paperwork through creative accounting and they played the numbers game and this game was to make a number of fraudulent claims based upon dodgy accounting or fabricated accounting, the numbers game came into play as in around 85% of cases people simply paid without question.

Yes, DWP debts can be statute barred but it depends upon many factors, you need the original contract with all its terms and conditions and you need to read it carefully, depending on the dates and it is not so much what is contained within the contract, but what isn't contained within the contract. If it makes no reference or specific conditions to allow them to collect after a specific period then it becomes statute barred.

If you took out a loan for £100 and it was to be deducted from your benefits at £5 per week for 20 weeks and it was deducted by them at the prescribed rate for the required number of weeks then it is paid, if it was their responsibility to collect it and they didn't then it is their mistake and not yours, then tough its their problem and not yours.
