hi the last time I asked for info from this site was January 2018 ,can not believe its been so long,any way I was dealing with cabot dca,who has now passed my dept to global debt recovery, about 8/9 month ago I sent the prove the debt is mine letter..and now ive been sent photo copies what I can only explain as running balance statements,showing the loan and payments each month until I stopped paying,and telling me to contact them at collection ...is this classed as the contract I asked to see,if not can I have some very easy translation on what to do now please

so they are not even statements ?

do they show any transactions ?

no this is not even the slightest bit close to providing what you have asked for if that is all that they have sent ?

personally i would send them a simple letter 2 to 3 paragraphs, acknowledging receipt of their letter and then referring them to letters that they have already received, thats it nothing more, nothing less.

the second and third attachments appear to me to be details of your banking transactions ie your bank account details !?

might that be the case ?

it was a top up loan I got from Lloyds bank,the last time I made a payment to them was 2011.. since then the debt has been passed down from debt company to debt company, and apart from the latest which is global dept recovery I sent the 3 letters , and the outcome has been to just pass the dept on with no evidence of what I asked for...except of course this time ive received statements from the old bank account that shows the monthly payment being made each month..until I stopped in 2011,and closed the bank account..

has these been sold to a debt collection agency ?

i did see the name Cabot appear on their letter ?

do you have any paperwork of your own regarding this from LLoyds bank ?

if this has been sold to a DCA and it was a loan then the bank have no right to be sending them any details in relation to your actual bank account !! that is a breach of your data !!

your next letter could be asking them HOW they came to be in possession of your bank account details !! that could scare the proverbial sh*t out of them !!

just helped someone with a similar thing, i penned a letter asking what the hell the purchasing DCA were doing with this persons bank details for a credit card debt ! they wrote back saying they would look into his complaint NEVER heard another thing that was 2 years ago !!

it was a loan through the bank.
the debt was sold to credit security ltd,
cabot
then robinson way,
marlin financial services,
back to cabot,
and now global ..
only paper work I have from the bank is saying they have assigned robinson way to recover the loan...who then passed it back to the bank who then assigned cabot (marlin) same company..

when I asked global to send me proof of the loan I sent the £1 postal order,they sent it back saying,

we acknowledge receipt of your recent letter and have asked our client to provide the documentation requested.

we do not request a fee and so have returned your £1.00 postal order.

we will send you this information as soon as we receive it..

I do not have any paperwork from the bank about the loan agreement, I do have the letter from Lloyds saying they have passes my debt onto the debt company.in the year 2013


would it be possible to show me the next letter I need to send,with the words you used regarding breaching my personal data .(hope you don't mind me asking for your help with this)
im so very grateful for your help,as I was getting panicky when they sent me the bank statements ,thinking they had finally got me.x

this sounds very much like it is statute barred to me , it all depends on the date of the default notice.

certainly sounds very much like it was assigned to someone within the Cabot group, we have to tread a little carefully with Cabot and statute barred from experience.
