Signing Documents - Illegal or Not

I have read an intersting piece today about a man who refused to sign the sex offenders register and it made interesting reading and sparked my interest immensely.

What is the sex offenders register? in reality it is little more than a contract you enter and you have to submit yourself to enter this contract of your own free will for it to become valid and if you are ordered by a court to sign it then you are not entering it of your own free will and if you enter any contract by anything other than of your own free will then it is classed as duress and the contract cannot come into force under both English Contract Law and European Contract Protocols, so no contract exists.

Does this means that everyone on the sex offenders register has entered a contract which is invalid and cannot come into force and it is totally illegal.

Lets put this into perspective and look at the specific wording here "a court ordered ABC to sign the sex offenders register" which automatically means two things, firstly a court has no power to put someone on the sex offenders register, and secondly they are trying to force you to sign a contract which makes it invalid from the outset and it cannot come into force.

CHAPTER 1 - GENERAL PROVISIONS

Section 1 - Scope of the Principles

Article 1.101 (ex art. 1.101) - Application of the Principles

(1) These Principles are intended to be applied as general rules of contract law in the European Communities.
(2) These Principles will apply when the parties have agreed to incorporate them into their contract or that their contract is to be governed by them.
(3) These Principles may be applied when the parties:
(a) have agreed that their contract is to be governed by "general principles of law", the "lex mercatoria" or the like; or
(b) have not chosen any system or rules of law to govern their contract.

(4) These Principles may provide a solution to the issue raised where the system or rules of law applicable do not do so.

These were ratified into all EU member states legislation and all EU member states are bound by them.

Article 2.102 (ex art. 5.102) - Intention

The intention of a party to be legally bound by contract is to be determined from the party's statements or conduct as they were reasonably understood by the other party.

So, you have to agree to be legally bound by then and sign the contract, or you refuse to sign the contract and they can do nothing about it.

Article 4.108 (ex art. 6.108) - Threats

A party may avoid a contract when it has been led to conclude it by the other party's imminent and serious threat of an act:
(a) which is wrongful in itself, or
(b) which it is wrongful to use as a means to obtain the conclusion of the contract ,
unless in the circumstances the first party had a reasonable alternative.

So you refuse to sign the contract and the court threatens to fine you or send you to prison for refusing to sign this contract, straight away this is duress by threats of an act and the threat is sufficient, irrespective of whether or not they carry out the act.

CHAPTER 2 - FORMATION

Section 1 - General Provisions

Article 2.101 (ex art. 5.101) - Conditions for the Conclusion of a Contract
(1) A contract is concluded if:
(a) the parties intend to be legally bound, and
(b) they reach a sufficient agreement
without any further requirement.
(2) A contract need not be concluded or evidenced in writing nor is it subject to any other requirement as to form. The contract may be proved by any means, including witnesses.
