Hi guys

The Light - are the courts who hold your records exempt from S.A.R. compliance? Is that why you used request and notice? Just curious.

Cheers!

Post by Jimmyjack Wed May 15, 2019 10:14 am

Hope you guys dont mind my post on this thread but sars requests are now free ;

The right existed under the Data Protection Act 1998, but organisations were allowed to charge a fee of £10 to provide you with the information.

Following changes to data protection legislation introduced by EU-wide regulation called GDPR, you can now make a subject access request for free.

If a company tries to charge you a fee, inform them that, as of 25 May 2018, subject access requests can be made for free when GDPR became law in the UK as the Data Protection Act 2018.

SUBJECT ACESS REQUEST - Page 2 Empty Re: SUBJECT ACESS REQUEST

Post by Jimmyjack Wed May 15, 2019 2:01 pm

This is another template that I sourced from the ICO website...may be of use to others.

Letter template

[Your full address]

[Phone number]

[The date]

[Name and address of the organisation]

Dear Sir or Madam

Subject access request

[Your full name and address and any other details to help identify you and the data you want.]

Please supply the data about me that I am entitled to under data protection law relating to: [give specific details of the data you want, for example:

my personnel file
emails between ‘person A’ and ‘person B’ (from 1 June 2017 to 1 Sept 2017)
my medical records (between 2014 and 2017) held by ‘Dr C’ at ‘hospital D’
CCTV camera situated at (‘location E’) on 23 May 2017 between 11am and 5pm
copies of statements (between 2013 and 2017) held in account number xxxxx.]
If you need any more data from me, please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

If you do not normally deal with these requests, please pass this letter to your DataProtection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

Yours faithfully

Just be aware that despite the ICO requiring organisations to comply within one month, they can take months in reality (from experience they make out they don't understand your initial request / ask you to re-confirm exactly what you want etc.) JUST GIVE US ALL THE DAMN DATA ELSE YOU'RE BREAKING THE LAW! Smile

Therefore its is very important to get your DSAR in asap / the moment you get a letter in relation to an alleged debt etc.

As previously asked, how can obtaining data help fight a debt? I have used irresponsible lending claims, F.O. and 3 letters successfully however I have a few lingering debts that don't fall into the same categories as above and would like to dig a little deeper and go further down this rabbit hole!

Hi Dianne,

It helps you fight a debt as follow.

If, for example, you were to use the 3 letter template process (found on the home page) against a debt purchaser or debt collection agency (the latter simply collect on behalf of the debt purchaser) you will see that we ask for specific documents (and true copies of these...) to EVIDENCE any alleged debt.

In the meantime, a SAR (Subject Access Request) to an OC (Original Creditor) will provide evidence of any alleged debt (credit agreements, default notices etc).

If / when you receive a document from a debt purchaser / DCA you can then compare what they have sent you with the REAL evidence you have via a SAR. If you see any contradictions etc, then that tells you the DP/DCA has NOT, in fact, evidenced an alleged debt.

Hope that makes sense Smile

(And not just contradictions but copy and paste type ‘jobs’ etc where a DP/DCA may try and pass a document off which is clearly not a true copy...)

In order to establish the original date of default, I want to SAR Barclays, they now have a digital form to fill in. I presume this is ok to use and can’t be used against me as an acknowledgment?

FYI and from experience, I very much doubt you’ll receive a default notice as part of your SAR request. I wonder why… Wink

That’s fairly scandalous, the cheeky gits. They should get into big trouble for that being against gdpr

You may also find that you won’t receive Ts & Cs, which are “not considered personal information” (according to the scum that are HSBC when I dealt with them at least).

The ICO are a bit vague about this, they say a company may require it.

You could look at it this way, have they contacted you previously ,in which case
they have your address from which they received a response from.

Alternatively you could 'require' the id of their CEO and whoever signed that
letter. 'Its your requirement because you take security seriously'
