SUCCESS - 3 Letter
Hi everyone out there. After a long time battling Moorcroft for an alleged debt, i finally got a confirmation letter that they won't be Actively pursuing the account anymore. I did the sending of the the 3 letters and then 30 days later i sent the 'ESTOPPEL' and then a few days later they sent me the letter. I've uploaded the letter so all can see. Stick to your guns and cross fingers to you all that things will turn out OK. A big thanks to all on here that has helped out and especially to 'daveiron' for his help.

Your letter shows that the debt collection agent (Moorcroft) will no longer be pursing you. However, their client (any idea who that is?) will no doubt get another debt collection agent onto you.

A/ Short answer, legal standing!
Debt Purchaser:
These companies purchase (alleged) debts. As such, a debt purchaser has some legal authority to chase you for payment as part of their claim to an alleged debt but you still have the legal right to challenge their claim i.e. to demand that they provide the necessary evidence to substantiate their claim.
The letters process is very effective here as debt purchases rarely have all the necessary documents (agreements/contracts/default notices etc) that are required as evidence.

After you have followed the three letter process, a debt purchaser can still attempt to take you to court (via a solicitor) if they think they can win. Thanks again all for the info as i would of been stuck as what to do if i wouldn't of got help off this site.
Thanks 'Mrblue' for the info, and Moorcroft are trying to collect on behalf of a bank. I am aware that the bank will try and employ another DCA to collect the alleged debt so i will follow the same protocol again of the 3 letters and the Estoppel.

there is a good chance that the bank will sell this debt to one of the vultures now.
do you have any of your own paperwork for this account? such as the agreement, default notice or any statements
if not now would be a good time to submit a sar request to the bank.
alternatively the bank could issue proceedings themselves but this is not their usual approach

so you sent a CCA request, did they send you a copy of the agreement ?
I actually meant do you have any of your OWN documents on this, not what you have been sent since defaulting by the DCA
what type of documents have the DCA sent ? agreement? default notice? statements ?

They sent me a copy of the 'Agreement' which was done online and 'statements' which the bank sent them as i did the CCA request as i haven't got my own and the bank sent me the 'Default Notice'. Hope this helps.
