Hi all,

You may have seen my previous topic 'Help required with CCJ defence'.

Quick recap: HSBC won their case against me, so I now 'lawfully' owe approx £7.5-8k.

Good news though is that after three years, around £45k+ to other banks hasn't been to court, so three letters are working for now.

Anyway, I called HSBC's litigation dept today to arrange some type of repayment. I have been asked to pay the lot back in Nov by the court.

I have a new job now; good salary, but no savings or assets. I have a car worth £10k and need it for work.

HSBC said they will post an income and expenditure form. I will complete and return, but estimated I can spare £20 - £100 per month which I can't imagine they'll accept.

I don't want an attachment of earnings as they might take a chunk every month and despite the good salary, I am skint every month. I had to admit in court that I was working. I had been unemployed for a while hence the judge asking.

Any thoughts or advice on paying the minimum, protecting my car and avoiding an attachment of earnings?

I might be wrong, but telling a private corp your income etc is none of their business. I would hold fire until you hear further advice from one of our friends here.

Thanks. Will do.

That said, the court has ordered a full repayment in Nov. I now need to negotiate terms. An income and expenditure form that maximises my outgoings within reason is apparently my only option. Otherwise it goes back before the judge.

Any advice always appreciated.

I've now had to complete an income & expenditure form (I&E) which I've shown leaves me £0 in my bank account each month, so I've made an offer of £0. My accounting is creative but not ridiculous. I'm awaiting HSBC's response.

Has anyone been to the next stage i.e. an external party or judge looking at your I&E?
