Anyone else had one of these for doctors subscriptions/dental care?

We had a NHS exemption certificate card awarded with our Working Tax Credit/Child Tax credit award which entitled us to free subscriptions and dental care...Since April we lost Child tax credit payments because my youngest daughter left education but still recieve Working tax credits...I wrongly presumed this meant we were still qualified for a NHS exemption certificate but apparently not.

After the wife had a £22 dental check up a couple of months ago, we have received a NHS "penalty charge" through the post stating that we now owe a total of £122 rising another £50 if we dont pay within 28 days.

They have threatened to send the claim to their debt recovery team, some DCA called Akinika debt recovery group.

I was just wandering If any here as had a similar problem and knows whether to wait till its passed onto the DCA and then use the 3 letters?

Personally I would send them the £22.00 along with a covering letter stating " This payment is made
in full and final settlement. The said treatment received was done so in the belief that I was still entitled
to free treatment .As it now appears this was in error, I enclose the cost of the treatment."


You could also if you wish quote the Bill of Rights Act 1689 : 'That all grants and promises of fines
and forfeitures of particular persons before conviction are illegal and void'

see what others think.

I second Daveiron's comments, I had a similar problem years ago, I sent them the appropriate fee for services & pointed out there was no loss (I never paid their extortion racket 'charge'), also Bill of Rights is also set in legislation - should they wish to play the 'system of commerce' they love so much. Without tempting fate after a few letters back & forth I heard no more.

Capita are the sh*tbags who run NHSBSA by the way...ring a bell there?
Yes TV Licensing & they also run credit checks for councils for those claiming single person entitlement on council tax (to check if anyone else resides there).

I have no problem paying the initial £22 for treatment received but theres no way im paying the so called "fine" of £100.

Im sure the debt guys will have "bought" my "debt" so i guess i should be grateful Very Happy

BTW...I used the 3 letter process years ago with success...does it still work?

Use these letters as you're dealing with a DCA not a purchaser:

Give us a shout when they contact you ,as those letters are aimed at Bank / credit card debts,
so some changes will be needed.

yes i had the same problem and BoeVat got them off my back ,at no point did they ever say that i had a "legal" obligation to pay them. seems to me these jokers just wait for someone to slip up and then they quickly slap a £100 charge on you ,don`t worry about the dentist because theses jokers pay the dentist and then try recoup it from you ,they won`t ever sign anything only made up names for example Shaz on the desk. They will lie to you making up daft statements ,the key is if they can`t say you legally owe them anything then you don`t owe them anything .Just download the BoeVat letters and after two letters you have asked them enough questions they can`t answer and you will have the proof they can`t comply.https://boevat.org.uk/
