3 LETTER PROCESS AGAINST DCA

Hi All,

ive been looking at the 3 letter process on various posts on here, and have followed the process and have had a response from the third letter now. Just wondering if someone could kindly help on what the next step is please thank you!

Debt collecting agent is Moorcroft, acting as agent for Barclaycard.

The only document received is print off of the statements only, no other documentation requested through the letters.

They basically state I need to refer to the original terms and conditions for further clarification as well as refer me onto citizens advice. In summary of the letter they quote that they remain instructed by their client to attempt to discuss payment options still for the debt and they have placed the account on hold for 30 days and await an update from me, or if they have not heard anything they will still attempt contact.

is it an estoppel letter which I should send now?

Hi, yes the estoppel comes next. It does NOT matter what they say, especially as they have produced pretty much nothing to evidence the alleged debt. So don’t let whatever this DCA say bother you. The law requires them to produce legal documents - as referred to in the three letter process. They won’t have them, so all they will do is harass you.

Moorcroft - should be called LESScroft - tend to send the same template letter over and over and over... They are one of the worst in terms of how pathetic their (lack of) effort is. In effect, their ‘strategy’ is to hope you give in. DON’T! Wink

Should I send the estoppel straight away then now I have had the reply.

Is there a template on here I can use or anything I can use or re-type out?

Just to set your expectation for the long run and as one great previous moderator used to say on the original GOODF site: “The template letters are usually only the overture to a long and laborious symphony.”

In other words, they will still try their luck even after you’ve sent them three letters and Estoppel. But they’ll give up eventually and sell on and you’ll have to go through all this again and again maybe, which has been the case in my experience and most others.

Your ultimate aim is for the alleged debts to become statute barred i.e. 6 years for England and Wales or 5 years for Scotland after the default date, so long as you do not so much as even suggest you owe them the alleged debt and you do not pay a penny towards any alleged debt in between.
