No. I have slightly reworded my instruction 3 as follows:

3. Photocopy all of the above i.e. the completed Reply Form, your enclosed letters a) and b) AND the postal order. These copies are for YOU to keep. Now send an A4 envelope containing the completed Reply Form, your letters and the postal order via Royal Mail Signed For delivery (better still, using their tracked service) ensuring the envelope gets to the solicitor BEFORE the 14 day deadline. I recommend you send off your envelope with one week to go at the very latest (don't risk leaving it too late!)

I would just like to add here,and this does not just apply to this thread.
There was no mention of receiving a letter of claim in the original post.
Would members in future please provide all relevant information.
I have seen over and over again Mr Blue attempting to get answers which
should have been supplied in the first instance .Its very much like pulling teeth.
It not only wastes time it can result in the wrong advice being given.

This is not aimed at the original poster but to anyone needing help.

OK got SAR weeks ago, today only received Mortimer Clarke Letter with CCA, the date on the letter was sent is apparently was sent 3weeks (I call BS cough). Tell me what you need to know to go from here

so they have sent you

i) a copy of an agreement ? any terms and conditions ?
ii) a copy of the default notice ?
iii) a copy of the notice of assignment ?
iv) signed statement on behalf of their client ? not sure what this means

Agreed with Waylander62. And the following message is not just directed at you it applies to anyone who might seek out help:

We keep banging on about the need for people to help us to help them.

If they don’t, they should not be surprised if we can’t help or it’s too late. Contrary to any potentially popular belief, we are not sitting around twiddling our thumbs. We all lead busy lives and it’s one thing for us to find time to help people, but quite another to be expected to drop everything (due to the short notice) and help people.

yes they sent me those 4 Items wayland (They look different from the ones in SAR and CCA does not have my details).
Defo they backed dated that letter by 3weeks.
The SAR doesn't appear to have default notice; been looking over and over it. Will look again after work.

this is why we ask that you let us know to be prepared for what they might send

compare the agreement and terms and conditions contained in the SAR with what mortimer have sent

look for a default notice in the SAR ( if there isn't one then we could have dealt with this weeks ago )

with the greatest respect you have only answered part of my last post i asked about assignment, terms and conditions and what this signed statement is also

I would be amazed if the SAR including a default notice. I have never received. a default notice in any of my SARs and despite explicitly asking for one or asking why, after receiving a SAR, the default notice was missing.

However, I always kept the original default notices if ever received Wink

Ok Thankyou very much Waylander,

i) I going to read through both copies of CCA and scan the pages for a default notice again this evening in the SAR. (the CCA is like over a month late , we did give them 7days in request also they refuse to send Deeds of Assignment)

ii) yes an alleged defult notice

iii) they sent copy of notice of assignment

iv) The signed Statement is Cabot claiming my postal order was to pay £1.00 off the alleged debt (isnt the £1.00 to charge for request only?)

Also I did send them letter 1 and 2 just before they sent the per-protocal letter, do I send them letter 3 as they refuse to send deeds?

I just notice this, in the letter they given me 14 days, as they blatantly backed dated letter (I received letter yesterday evening). that means the deadline passed before receiving the letter.

The word Pr*cks come to mind for their behavior.

you MUST reply to this immediately pointing out that the £1 was the statutory fee required for a copy of the agreement and was NOT to be used for making any payment towards the alleged debt !!

did your CCA not make it clear to them that this was the case ?

so no default in the SAR but cabot have provided one ?? what is the date on the default notice ?

In my response to a letter of claim instructions post (Jan 04, 2021 7:06 pm) where it took a very long time for me to compose very clear instructions for you, I did state:

enclose a postal order for £1 with letter a) and on that postal order, ensure you write: payment for Consumer Credit Agreement request only

Did you adhere to every detail in that post let alone this point in italics?
