New DCA letter

Apologies, this is a repost as I think I posted this topic in the wrong (general) section just now

After being harassed by several DCAs over the last few years for alleged overdraft and credit card charges and having followed the three letter process a while ago, Ive just received another 2 letters from a new DCA, the latter offering a 50% discount etc.

Is it best to follow the NCA route at this time as I feel I shouldn’t ignore them. I’m not familiar with this new approach, so any advice gratefully received.

I presume its a debt purchaser & not a debt collector.
If its a purchaser personally i would take the NoCA route.
Its important you study the process so you comprehend it.(links provided)
While you are researching that ,send a Data Subject Access Request to
them.
Its always a good sign when they offer large discounts .

Remember with this route you are removing controvesy.

Thanks, how do I know if it’s one or the other? Actually I think it might be a collector as the letter states they may hand it back to the previous lot.

Acording to their site they are purchasers.

Ok Ruthbridge are collectors,cabot purchasers.
Send a DSAR to them ,they obviously hold some of your data.
keep hold of it when you get it.
this will give you about a month ,in which time you will comprehend the
NoCA route

And the fact they offered you such a ‘large’ discount proves to some extent they know they can’t fully evidence the alleged debt and they hope you’ll at least pay something. Wink

Thanks folks. I have the DSAR text so I’ll just send to the address on the letter from the collector then?

Thats good, Its worth learning the process,you will find also that the
principle can be used for other things as well and it keeps you in honour at
all times.

Is the following all that’s needed for the DSAR?

This is a Data Subject Access Request ,as per the GDPR regulations please
supply all Data you hold for (your name) including but not limited to Data
pertaining to alleged account no xxxxxxx . Please supply this data within the
regulation timescale.

How do they know it’s a genuine request with no proof of ID etc?
Presume I just put my name and address but not the sovereign bit?

Yes thats all you need in your request. They have your address when they
contacted you ,so there is no reason why they should want ID unless you
want it to go to a different address.

They’re wanting proof of identity in response to the SAR

When I have done DSAR in the past & ID was requested, my reply: 'the requested ID asked for does not exist, therefore cannot be furnished'. Try it they may go for that?
