4 corner rule & windowed envelopes Empty 4 corner rule & windowed envelopes

Afternoon all,

just found this definition in blacks law for the 4 corner rule:

https://thelawdictionary.org/four-corners/

The face of a written instrument. That which is contained on the face of a deed (without any aid from the knowledge of the circumstances under which it is made) is said to be within its four corners, because every deed Is still supposed to be written on one entire skin, and so to have but four corners.To look at the four corners of an instrument is to examine the whole of it, so as to construe it as a whole, without reference to any one part more than another. 2 Smith,Lead. Cas. 295.

this has been posted on telegram on windowed envelopes:

WINDOW ENVELOPES

A windowed envelope appears to be a clear attempt to obtain tacit agreement from the recipient, because it is, in effect, internal mail. The purpose of window envelopes is for internal mail!

Window envelopes aren’t actually addressed to anyone, because no address is written on the envelope - yet it cajoles you to look inside, and respond as though it was addressed to you.

Postage wasn’t paid and cancelled correctly either, so It’s actually in breach of Section 1 of the Forgery Act 1981 to send such an instrument in the mail.

But they’re all at it now, and Royal Mail don’t seem to mind - they’re getting paid after all….

Here’s some more Acts (Acts bind corporations, not men and women) that a windowed envelope falls foul of:

Definitions

1)False instrument

Section 1 Forgery Act 1981 states:

A person is guilty of forgery if he makes a false instrument, with the intention that he or another shall use it to induce somebody to accept it as genuine, and by reason of so accepting it to do or not to do some act to his own or any other person’s prejudice.”

It must be shown that the defendant intended for the false instrument it be used to induce somebody to accept it as genuine and, by reason of so accepting it, to do or not to do some act to his own or another’s prejudice: R. v. Mary Sylvia Campbell (1985) 80 Cr.App.R. 47, CA.

An intention to induce another to accept a copy of a forgery will also suffices: R v Ondhia (1998) 2 Cr.App.R 150 CA.

2)Instrument:

Section 8 Forgery and Counterfeiting Act 1981:

Instrument includes any document, postage stamp (or mark denoting payment), Inland Revenue stamp, disk tape, sound track or other device on which information is stored by any means. It does not include a currency note (see offences under sections 14, 16, 17, 20 and 21 Forgery and Counterfeiting Act 1981).

Usually, the windowed envelope will also have a P.O. Box as a return address, and a pre-paid/franked postage stamp in the right-hand corner that hasn’t even been cancelled, further compounding the lack of attention to UPU protocols. The majority of franked mail posted in the UK does not meet UPU requirements, so therefore is a direct violation of the Universal Postal Union Convention Manual 2018, Article 9 - Violations (Subsection 2.1.2, 2.1.3).

   2.1.2 prepayment impressions;

   2.1.3 impressions of franking machines or printing presses;

Royal Mail don’t seem to care about this situation, but I’m sure the UPU - who were formed by international treaty and have jurisdiction in over 190 countries worldwide - would be very interested if a complaint were to raise. Especially if you keep receiving them over and over again from the same company who are persistently making threats with menace, and demanding monies without proof of contract through the UPU postal system.

And if you were to use postal mechanics/stamp technology on your responses to the same said company, but the letters kept coming, your Notices are under jurisdiction would UPU! No-one can interfere with the mail, is a well known maxim, Mail fraud carries 20yrs, normal fraud just 7 max.
