Questions about Legalese Empty Questions about Legalese

Post by Inf1n1ty Fri Sep 15, 2023 8:41 am

Hopefully what I am asking may end up (hopefully) being a way to their game of deciet against them.

Legalese from my innerstanding is not common English though from the perspective of an uneducated human being it appears to common everyday spoken English, Legalese is obviously one method they use to decieve most of us and am I correct to assume that as I am NOT qualified (BAR) I am not only sure to mistakenly assume that what I have read has a common English meaning and this can be my undoing.

As I am not qualified as a BAR member then I am not qualified to know Legalese, even if I diligently use a Legal Dictionary and I successfully create a letter in Legalese expressing anything in my own defence is irrelevant because I am NOT qualified to not just use it but I am NOT qualified to even use Legalese at all.

Can I use this lack of qualification to insist that the proceedings be held in common English only so I am not unknowingly decieved?

And does this make the "ignorance of the law is no excuse" an Oxymoron, as I am NOT qualified to even know Legalese and as their laws are written in the language that I am not actually qualified to know how can my ignorance be denied as any interpretation I make through my own educated translation of what appears as Common English will by default make my translation of any law incorrect and invaild as I am not qualified to even attempt to make sense of that law. This makes their "ignorance of the law is no excuse" an Oxymoron.

And as there must be disclosure of anything and everything made to me them not actually telling me'us/we beforehand that the ptoceedings are held in a language I am not qualified to speak is not even Common English making their silence about this unlawful?

Am I even somewhat on to something of actual merit here or am I full of empty hopes & false beliefs?

Questions about Legalese Empty Re: Questions about Legalese

Difficult to comment with some context, for example what sort of proceedings you are involved with. In general in courts in England and Wales, every day words have their everyday meaning, although there are some technical terms, and some general purpose words that have specific meanings in some contexts (for example "bench" in a Magistrates Court).

Are there specific words or phrases giving you trouble? As a litigant in person I'm sure you would be entitled to ask for these to be explained.

You can insist anything done is in basic plain English and this includes documentation and court hearings and if any legalese is used it is up to the clerk to inform you it is legalese and its technical meaning as the clerk is there to work for you, so when do they do this? errr never as most are employed in magistrates courts which is the private company called HMCTS and all they bother about is money, their money.
