Clean air PCN Charge

Hi all,

I have been away & come back to a letter & a notice from a city council saying, i owe money for going threw a clean air zone & have failed to pay £9 caz charge.
1) Notice saying i owe £69. Dated 30/08/23
2) letter saying, to the owner/keeper/hirer, that i owe £129 wow. Dated 04/10/23

I dident even no, i went threw a clean air zone wow.
Whats my best options????
May bee! Send them apromissory note? But then i am admitting charge?
Can not find anything on goodf forum pages, so thought lets see what we can do.

Just thinking is it best to put the dvla in notice not to share my details wth another 3rd party?
Is there a forum on this?

Just found this article,

Bristol City Council turned down the couple's appeal on those grounds down. When the anonymous driver took up the case he made the same representations to the Traffic Penalty Tribunal and Bristol City Council withdrew the case.

Explaining his argument, the driver said: “A lot of it is pretty technical, but basically I think that the order being used by the council to issue fines under the Clean Air Zone is not worth the paper it’s written on. There's about ten different points, but I’ll give three examples - the first is that the PCN every driver receives says it is being issued under the authority of something called the ‘Bristol City Council Clean Air Zone Charging Order 2022’.

"No such order exists - it’s actually called the ‘Bristol Clean Air Zone Charging Order 2022’. It sounds technical, but that’s enough to get every fine thrown out for a start.

“There’s another maybe 10 other omissions, errors or breaches which a judge would view as making the PCN fines unenforceable. PCNs are overturned because of procedural impropriety on behalf of the charging authority, and the wording of the PCN tells drivers that if they have a time-limited option to pay a reduced fine, but if they appeal and lose they have to pay the full fine. That is not true, and I believe that counts as ‘threatening, improper and coercive’, which under the law means the fine is not legal because the notice contains that wording.

He cited other aspects of Bristol’s Clean Air Zone, from claiming the signage around the entrances to the Clean Air Zone is not sufficient or legal, to a claim that the Charging Order which created the Clean Air Zone is not accompanied by a map of the zone - both of which are flatly denied by Bristol City Council

We all need to take a stand against the WEF climate agenda scam and the fuel poverty it will cause ordinary people. If we continue to accept it will just get harder to live. Send the DCA letters back unopened and park your car away from your home. The bottom feeders will give up eventually.

Council parking PCNs can and are routinely thrown out on technical grounds that wouldn't be considered in criminal cases. I think that is part of the deal with decrim penalties, the Council are given the powers but in exchange are expected do do it exactly by the book.

It's pretty much standard for the first challenge to the Council to be rejected, so anyone in that position should definitely take it to the tribunal.

Hi, i sent them a letter signed for still waiting for reply.
I wrote some points of law in the letter & more than happy to play the game on the court in a room they call court.
First off, I will be looking for the first 3 letters to get me into court.
1)Court fees
2) court costs
3) whats #3? Is it??? Whos making the claim?
A corporation can not make a case. Man v man.
Will let ya no how it all gos.

They have refused my appal on the grounds that i was to late. There letter was sent to the wrong house #.
Now they are saying that i must wait for them to send out a witness form hahaha.
Also how does a £9 charge end up being around £70 if not paid in there time spam wow.
Then it gos up again if not paid wow. How are these monsters getting away wth this wow.
Lets see how this pans out enit.
