Restons chasing old catalog debts

Hi Restons have rolled 3 old debts up into one claim and are threatening court action. I have asked for proof and they replied sending a copy of an agreement with no signature on it. Can they go anywhere with this . Could anyone offer any advice please .

Are they statute barred? if so you have a claim of theft and fraud and a large civil claim against them.

Maxim 4 of Commercial law clearly states they must express this as an affidavit and it must be true, correct, and complete.

If it is unsigned then it isn't complete as nobody has signed it and therefore it is not complete as nobody is acepting liability for these claims, and as for rolling three alleged debts into one? thye have some paperwork but not it all and hoping you fall for their fraudulent actions, read sec 7 of the Fraud Act 2006, fraud by false representation.

You rebut their claims on the grounds that they have failed to provide the correct documentation for the three alleged debts and by providing some of the documentation they are committing fraud, and that they are alsi in breach of maxim 4 of commercial law by not accepting liability for their claims.

Tell them you will address these alleged debts on their individual basis.
You require 'True or cerified copies ' of the agreements. also ask them
if they or the alleged creditor hold the original agreements.

The debts are not statute barred they came about when the government started there campaign about paying debt back quicker and the catalogue company’s double the payments we could not pay double payments and the next thing we knew they hold sold the accounts and Lowell’s purchased them and then passed them on to debt managers who have passed them on to Restons. Thanks for the advice guys.

At the end of the day the only one with any claim is the 'Holder in due course' of
the original agreements.

Agreed with all of the advice provided. And it’s clear Restons haven’t got a leg to stand on if what you’ve said so far is correct. So fear not, and adopt the advice given.

Lowells and Restons are chancer companies, in other words they try every dirty trick they can think of and hope you agree and consent to it.

If they are rolling three debts into one larger debt they don't have the paperwork they require lawfully and this is a clear case of fraud in itself.

Yep, a similar thing happened to me. Two alleged debts rolled into one by the original creditor and sold as one. As such, the dumb and ignorant debt purchaser assumed it was one type of debt and had therefore chased the wrong type of alleged debt for nothing (as they could never have located the correct paperwork) and for six years (now statute barred and therefore no longer legally enforceable). Bless them, what a waste of their time and money (their people, the several DCAs they assigned and a ‘solicitor’ who was just as dumb and ignorant).

It’s funny how they never give up being so dumb and ignorant, but welcome to the world of banking, debt purchasing and debt collecting; they assume you’re the dumb (and fearful) one and will give in. Well the likes of us have got news for them…

They do it because there is always a sucker who sees a clown dressed in a uniform as "having authority" and these ignorant people merely assume and question nothing, many here would ask what authority have you got over me and just laugh in their faces when they try to convince you they have authority over you. These are the ones who pay up.
