Hi All,

Just found this website after months of searching for an answer as to what happened to GOODF. Yay finally found you guys and this site!

I am not exactly sure where to start but was hoping I could get some advice. I have been sent a Default Notice from Credit Corp which refers to Section 88 of the National Credit Code.

I have previously sent them all three letters which they responded to one insufficiently and then declined to provide anything else as they believed what they had provided was good enough. That was in 2014/2015 - nothing since then and now out of the blue, BAM, a Default Notice.

I have no idea what my next step is and would really appreciate any advice.

Had credit corp ever say in any of their letters that: " moreover, the sale of debts is a longstanding accepted pratice in australia and anz is not required to provide notice to you. As it is an accepted practice then ask them to prove you with the Act that lets any debt be sold. If they say that it is an accepted practice then there must be an act that allows the sale of debt. An accepted practice is not an act and so you are asking them to show you the act that allows debt purchasing to happen? At the time i got the letter from credit corp that i never thought about asking them to show me the act that allows the sale of debt and where can i go to look up the act. Just write a simple letter to credit corp asking them to show you this act that they say allows the sale of debt from anz to them or any debt purchaser. It would be good to know this act that they are relying upon.

Where they served a fee schedule or bill with the 4 notice? sounds like they are testing the waters to see if thee knows the next step

They were originally but I can't find any of my previous documentation (stupid me misplaced it thinking it was done and dusted). Given I haven't got the proof of the three letter prior should I start the process again? The person emailing me is a new person not the same account manager as before.

I guess I just don't know where I stand with the letter process as I don't really understand what time frames I have with the legislation they are citing.

I am still quite new to all of this - in terms of my understanding. I still haven't reached that point yet where I am happy to hear from them. It still makes me really nervous and anxious because I am terrified I will eff it up and they will be like "ha ha you idiot". LOL.

In all of my dealings with DCA I have never seen this notice under Section 88 before.
