So they have sent back a few photocopied articles like the signed agreement etc but have also stated to many of the points that they are just not obliged to provide information.

We have no actual certified copies, no default notice, no verification of claim (they refuse as not obliged)

In a nut shell they cant really provide all the info but have thrown back a lot of photocopies and excuses.

Where do we stand? shall we send the PRE-ACTION court letter again asking for the full information?

What's the original debt for ?

Bank loan Tiggy started 2004 last payment was around 2015 (£13k but with additional costs is around 15k) company is 1st Credit.

Asking for the documents is asking for proof of claim.

If they don't want to provide proof of claim then focus on the fact that you've said you would pay if they proved their claim.

Seems that to date they have not done this.

Make sure all this gets in front of the magistrates face in your documentation and at the hearing should it go there.

Its just so wrong that someone you have no contractual arrangements with can take you to court.

Im helping a friend, well actually a few now lol. she basically fell on hard times, divorced with three kids, had taken this loan in her name but the other half is long gone a few years back now. Life is just tough and stressful enough. When you consider that the money never existed in the first place and that the persons name on the letters is the strawman fiction of the real human being. coupled with the fact that the banks just conjure up this money from thin air preying on our human weaknesses and societal needs, its plain criminal.

Im still learning all this tbh but Im trying.

We will send over the Pre Court Action letter, I have added a few personal bits to the letter like the "Im willing to settle the debt provided the correct documentation as asked can be presented"

I have to send the letter as they only gave us 7 days from the date of the last letter before starting proceedings. Im actually liking the challenge and may take it all the way to the court and represent my friend. Cant be any worse can it?

I need to do some reading up as the court procedures may well catch us out.

Lets see what this letter does in the mean time.

I fear you have just admitted to the debt.

In future: "I am willing to settle any debt i might lawfully owe on the condition that you provide proof claim by supplying .... (all those things listed in the letters.)

well i had to send it as out of time.....difficult to ascertain all this legal jargon isnt it.......to late now lets see what happens.

This is what i wrote down

'i would draw your attention to the fact that should you be able to prove your claim by providing the documents that i have asked for then i will be able to settle this matter"

that no good?
