Received letter from Wescot on behalf of Paypal

Hello,

I have received a letter from Wescot on behalf of Paypal seeking to collect £4k.
This is in relation to a Paypal Working Capital Loan a few years ago that could not be paid off due to my eBay account being restricted.

This loan hasn’t been paid for a few years now and a previous debt collection agency sent me a letter about collection on behalf of Paypal in 2016 and I sent them a long one page letter that Faljay from another forum made me letter back saying:

I DO NOT RECOGNIZE OR ACKNOWLEDGE ANY DEBT TO YOUR CLIENT OR YOUR COMPANY IN ANY WAY SHAPE OR FORM

THIS IS A VALID DISPUTE AND MUST BE TREATED AS SUCH UNDER THE FCA REGULATIONS

The above is only one little piece from the letter. It was successful and the debt collection agency replied to it basically saying we want nothing to do with your case.

I haven’t been contacted since from them or Paypal. It is only recently when I have now received a letter from Wescot asking for the money on behalf of their client Paypal.

Do I sent them the letter the again to Wescot and hope that they also go away? Or do I try a different approach?

I remember that on Paypal Working Capital Loan that it stated that it is not Consumer Credit Act 1974 regulated, does this have any negative affect on my situation?

Hi, If Faljays letter worked before ,why not try it again.

When was the last payment made ?

Yeah I think I will try the Faljay letter again to the new collection agency, just wasn’t sure if I should use the 3 letter process, Last payment was made 2016, so it is not 6 years yet for statute of limitations.

I really would like to know about the loan not being covered under CCA1974 regulations and Paypal being based in Luxembourg would they still be able to recover the debt or will they just keep sending DCA’s after me and I keep sending them away and hopefully 6 years will be up and the debt written off?

All you need to do use the template letters from this site but tweak them to make explicit reference to the FCA regulations.

That is to say; you make it clear to them that until they provide all of the documents listed in the template letters, the alleged debt will remain in dispute (because there is no complete evidence without those documents...) and, as such (given there is a dispute) they are breaking FCA regulations should they continue to attempt any form of payment collection.

That - in my experience - stops the letters...

Very much appreciated MrBlue, I will look into it as I am sure I will have contact from One Source Enforcement pretty soon, as I have had no communication from them since November last year so want to be prepared just incase

Faljay was on the old GOODF site and was promoted to a site moderator I believe, we all posted a lot of good information and Faljay posted more than his share as well as actively helped site members. He shared some discord about the site with me and he was correct as he believed something was happening and it was, unknown to all of us, the site was sold off and during this process we were all asked to post considerable information and many of us did. Most of this information could have been used in two ways, it could have been used to increase the asset value of the site which would increase the monetary value of the site; and it could have been to gather the best and most effective information from the most effective posters and be passsed to debt collection companies so they were aware of our tactics and could use this information to thwart our efforts.

Faljay left the site and joined Squatalosers and they have tried to get him around to their way of thinking and this has failed, he makes his own decisions and forms his own views.

Good insight assassin in how you guys managed to stick together and help all of us, which im sure we are all very grateful of, even though he left the sight it sounds that contact between you’s is on going, glad those b*stard debt collection agencies wern’t tipped off

Faljay (jay) was very supportive in PMs to me too (not just general posts) and like I said, as a result, DCAs and a Debt Purchaser to date have backed off. I will be forever grateful to him as I am the others who are still helping on this site, which encourages me to in turn help others Smile
