They say the debt still exists so the balance is not zero however they have decided not to chase it anymore. It's a final bill from when my phone broke at the end of my contract so I no longer used it. If I settle the debt it will mean my credit file is update and therefore these defaults will show for an extra 2 years on my credit file so I would be best to let it go quietly as Statute Barred I think confused

I suggested a settlement figure in return for negative information being removed but was told they couldn't do this although this was only via a telephone call.

I am trying to clear my credit file up as well as clear my debts, is there any avenue I can go down to remove defaults? They were registered correctly.

Apologies for multiple posts regarding different companies, these are the final few negative accounts sitting on my credit file so I am trying to 'mop them up' the best way possible and they don't seem to fall into the 3 letters or Irresponsible Lending category!

Hi Dianne
If they have decided to stop pursuing you then they can not show that money is still owed. The Information comissioners office state the following on their website "However, where an organisation has decided to stop pursuing a debtor for payment, it would appear unfair to show that money is still owed under the account."

Open a dispute with the credit reference agencies and remind them of the above statement. Also report their actions to the information comissioners office (you can do this online) The balance should be changed to zero and the account marked "satisfied."

As for getting defaults removed though it is very hard and there is no guarentee you will be successful. You would need to keep disputing the accounts with the credit reference agencies and with the ICO.

The problem with the credit reference agencies especially equifax is that they just ask the creditor if the info is correct and if the creditor says yes they just close the dispute, they don't care about your side of the story at all

Thank you that is very useful information! I have give them the opportunity to resolve this first by contacting them in writing quoting the ICO then move onto working with the ICO! Like a Star @ heaven

be careful if you admit the debt you could start the 6 years again to be statute barred
