I sent Fidelite bank letter 2 and they have not responded within 10 working days and now I get a letter from Lloyds bank (O.C) stating fill out income and expenditure form/medical form if they do not receive this within 28 days they will resume collection activities!

So, I guess any claim made by Fidelite is invalid as they have not responded they have even passed the account back to Lloyds Bank? Is that not an abuse of process in a court of law?

Yes, they passed it onto Fidelite DCA now passed it back without telling me isn't that an abuse of process. I haven't sent estoppel now considering it however it has been 6 months since I sent bank letter 3.

Would not hurt to send estoppel to finish the process.

Just wait for Lloyds to pass it to the next bottom feeders,& repeat.

Hi pipsaholic,

Yes finish off with the estoppel, but it looks like the three letters have worked because Fidelite DCA has passed it back to the bank. This tells us the bank hasn't sold your alleged debt on yet, no doubt they will pass it along to a new DCA (Debt Collection Agency).

But until they sell it, you may find it may go back and forth from debt collectors to the bank a few times after using the three letters.

It looks like Lloyds bank is sending you a income and expenditure form, to see what you can pay on this alleged debt. But only you can decide on this.

I have pointed this out before, this is a new debt, not too old. They may have all the paperwork if it proceeds to court. This is why I always say to wait until the debt has actually been sold on.

I agree with daveiron, if you decided;
Wait until Lloyds passes it on to the next bottom feeder. And always remember DCA's are not enforcement, have no powers and they cannot send court bailiffs to your home to drill any locks.

Very odd I have received a duplicate letter from Fidelite after sending letter 2. I have also received a letter from Lloyds bank asking for income and expenditure details? say I have ANOTHER 28 days to respond or normal collection activities will resume? I think they are chasing the debt with me also Fidelite at the same time?

Is this not an abuse of process or harassment/intimidation its causing me alarm and distress?

yes its harassment and causing alarm and distress, at one time i hated my letter box ( but no more ) ,
send the estoppel to the dca ,

Why would you tell a bank what your income and outgoings are, none of their business.

Personally with third party interlopers I ignore and just ANRRTS their letters & wait until the debt is sold on.
