After sending 3 letters and estoppel I received a letter today off 1st credit saying
Regrettable, we are considering weather to issue a statutory demand under the insolvency act (1986) which could result in bankruptcy proceedings being issued against you. The debt is for £5329.55

Whos the original creditor,what info did the OC provide to the 3 letters?
Do you own your own home ? Date of original agreement ?

The original creditor was lloyds TSB, the debt was from 2002 and 1st credit sent me a very bad photo copy of agreement and yes I own my own home.

can you put on here a photo of the credit agreement but take of your name and other details , when was the last payment and what date was the default notice,
look they want to scare you ,
they use the word ( considering ) (could result)

Do not phone them send them a bill or ignore them ,

Hi Mush,
here is another option ,something similar worked for me,but of course the choice is yours ,should you decide to base something on this please post results.

Dear xxxxx
I am in receipt of your letter dated xxxxx received xxxxxxx.

Take notice I reject your assumption / presumption that I owe your corporation money.
As I do not intend to engage in letter ping pong with you I will make my position clear,you should read this letter fully and carefully .

On (insert date) I requested documentation from Lloyds TSB for proof of claim regarding this alleged debt.In fact Lloyds TSB have now been asked on three (3) occasions to supply valid proof of claim ,this they have been unable to supply.

This leaves me somewhat bemused as I have on every occasion stated that I will pay any and all money I may lawfully owe to them upon valid proof of claim.Surely if they had proof of claim they would have supplied it and been paid,instead of selling it for pennies in the pound to bottom feeders like yourselves.

You also have been requested on three (3) occasions to supply proof of claim ,which you also seem unable to supply.
As you now intimate possible further proceedings in this matter I will be requiring additional information from yourselves so as to present a full defense in court.
The additional information I require from you is.

1. A signed statement from a named individual from Lloyds TSB that prior to the sale to you .that this agreement has never been sold or traded in any way.
2. A signed statement from a named individual from Lloyds TSB that no insurance claim has been made in respect of this claim.
These are in addition to the documentation requested that you have failed to so far provide. All including the original agreement will be required in court should you decide to proceed.

I trust this letter makes my position clear.

if pre 2007(i think) then they HAVE to send original agreement not reconstituted.

Hi mush,

Just had a look on the gov.uk website regarding Statuary Demands

From what i read there i would think it highly unlikely 1st Credit would take that route .

The costs are £ 990.00 Petition deposit ( for managing the bankruptcy)
£ 280.00 court costs + there is also a lot of investigation they must also complete .
I would not expect them to commit to what must be approaching 2K for a debt they clearly know they cannot provide proof of claim for.
Clearly just a scare tactic .
