Hi there, i was overpayed tax credits by about 1,500 i didn`t try and mislead them and now i have received a letter asking for the overpayment back, by a company called Advantis.I am not in a position at this moment to be able to afford to pay this amount back ,is there anything i can do because they sent me the overpayment without me knowing at the time. thankyou

I have dealt with Advantis before ,just debt collectors ,they ignore the
3 letters & give up after the third attempt.

Do you have copies all the paperwork you supplied to the benifits people,
hopefully you do if everything you supplied is true and you did not leave
anything out ,then any mistake they made in the calculations is down to
them and you have no obligation to pay. Its a tactic they have been using
for years ,and its believed by many that the staff are incentified to play
this scam.

Sort out your paperwork & check it .Then challenge their claim.

thanks daveiron ,the forms i filled in were fine ,the overpayment came about a year after i left that particular employment which i had been claiming for.they still thought i was working there i rang them to tell them to stop putting money in my account,as it happened i was entitled to some of it but not all now they want it back .

as per DI I have also had Advantis, they are just DCAs & seem to give up after a short while.

The DWP hmmm, just won another High Court case against them and they lie, cheat, and pull every trick in the book and I know from experience.

They have been caught out claiming monies not even owed to them on many occasions so follow DI's advice and fight them all the way.

thanks for the replies.On what grounds can i get out of this ,it was a straight forward overpayment and now a third party i presume has bought this debt and are trying to claim it for themselves ,i`m in no position to be able to pay this amount back. is there legislation that protects me because my circumstances have changed ,i am not in employment and are not claiming from the state . is there legislation where because it is not them (debt collectors)who have lost out, that they can not claim it as their own and so don`t have a right to it .thanks

If its still with Advantis they are only collectors. If its someone else
their initial letter to you should inform you of their status in this matter.
Try a DSAR to DWP requesting ALL data they hold on you and specifically
specify to include but not limited to telephone calls.

As above and get the full accounting as they often slip up with their fraudulent accounts.

No they dont as they have an in house team to claww back overpayments and if they pass this to a DCA you can bet its fraudulent as they pass it over to keep their hands clean and let others do their dirty work and in every case I have dealt with they have provided the DCA with fraudulent accounting and the DCA is acting in good faith. Suddenly the DWP will claim they provided incorrect accounting and claim "its an error on our part" and it goes nowhere.
