About The Billing Empty About The Billing

Post by discodave4093 Tue May 30, 2017 11:37 pm

Hi Everyone
I was wondering about the billing (fee schedules) as mentioned in the letters. On the old GOODF site which I have noticed slowly going downhill lately some members have been insisting you "shouldn't" bill and that it's a waste of time

A new version of the letters was posted on the forum with the fee schedules removed and basically any member who mentioned billing almost got the nose snapped off them

So I was just wondering if the people who removed the billing were right to do this or if the billing part should of been kept

Hopefully someone on here will know the answer to this

Hi discodave4093

i'm no expert, but given the subject matter and the nature of the business of the new owners, i'd say billing directly threatens them, so.....

Cheers!

About The Billing Empty Re: About The Billing

Your well within your rights to bill them for your time and costs. I think what the problem was people putting in bills for 1million for example and just wasting everyone else time with it all.

If you are expected to be going beyond normal obligations to resolves issues then yes bill them but be sensible, you wouldn't pay someone £10,000 for 30 mins on the phone, so why should they pay you that.

Record all the time you spend and costs involved and bill them accordingly. FYI some people have spent exhaustive hours dealing with companies and been given a nice bonus when proved in court, just record it and be sensible about the fee schedule.

If you are Self Employed and Keeping Books then You will pay Tax on any received funds.

Better start bagging your farts for future Gas Shortages. More useful than non existent unpaid Bills.

Just be glad to be rid of the problem.

About The Billing Empty Re: About The Billing

Post by daveiron Sat Jun 10, 2017 9:20 am

I have never used billing in the three letters as i believed it does not work .
However i have used it for other things with varying degrees of success .

For example Scottish Power said they needed to change the meter in my factory ,they sub contracted this to Lowery Beck.
An appointment was made & i waited for 9 hours on a Saturday in the freezing cold .Of course they failed to turn up.
I then billed Lowery Beck for 9 hours at our weekend rate + vat (£700). They paid it. & meter was never changed.

Two years later having switched supplier the whole " we need to change your meter" thing started again ,this time it was subbed to Siemens who further subbed to someone else. Again no one turned up ,so Siemens was billed. They refused to pay so i took them to small claims court.
I lost that & despite the fact they had made an appointment ,the judge said it did not form a contract.

Whilst I lost, it taught me that in future any of these appointments would be agreed by both sides that a contract was now in place.

Faljay had posted his updated dca letters and they do not have the billing in them as they do not work.

About The Billing Empty Re: About The Billing

On the old site i think a couple of people went to court after they billed. No doubt it was for a stupid figure.

If you go to court, it's homework, homework and homework. If you walk into court and say i want £9000, the judge is going to look at you and think what a dickhead.

Waffle is correct. If you decide to try and take it to a small claims court, keep your bill low. Before you open the door, you have got to unlock it. So far no one has claimed any money for the billing, but this does not mean some clever person will.

The debt collection agencies worry for when this day arrives. Because when one claims, then the door will be open for others. But you have got to do your homework before going to court, and like assassin says it is how you word things in court as well. And just because someone fails, does not mean the next person will fail.

On this site we recommend the 3 letters, estoppel, the bill and the new addition letter to go with the bill. If you don't like billing, don't bill. Simple as that. But what we will not have on this site, is any trolls who will try and derail any posts where a newbie may need help.

The 3 letters, The Estoppel and The Bill and The Cover Letter, is not meant to try and make money, it's to stop the debt collectors in their tracks before any court action. We do not recommend debt consolidation loans on this site either.
