Hello,

Intrum are chasing for an alleged credit card debt that defaulted in 2014.
They've had no response until a letter saying it's been passed on to their legal team and court action may take place.
Not a penny has been paid to them. There has been no admittance from me of the debt.
I requested a CCA which took 2 months to turn up.

In this pack are 20 pages which contain:
Statements leading up to the debt being defaulted. According to the statements, last payment made was
A copy of a CAS MART APPLICATION RETRIEVAL - credit application was made online in Jan 2009.
Copy of letter from original creditor headed Notice Of Assignment to inform that account has been transferred to 1st Credit.
Copy of letter from 1st Credit introducing themselves as legal owner of debt.
Copy of T's&C's, but these have raised some concerns with me.

1) in the "introduction" part of T&C's it says "This agreement is between us (name and address of bank) and you (my first initial, surname and an address which does not match the one on the original application).
The address used in the introduction is one at the top of all the statements and one I didn't live at until 2013, 4 years after the credit application was made.
2) Date at the top of 2 of the other printed pages (card conditions) is Sept 2008 shown along with a page number (only 1 and 2), time and a rather generic looking file name. Then you've got various other dates Aug 2014, file names at the bottom of others.

The cover letter says "We have enclosed a true copy of your credit agreement at the time the account was opened and at the point of default, and statements.". Well I don't think so, unless said bank knew where I was going to live 4 years into the future!

But I'm unsure as what to do now. The letter says I've 30 days to respond. The debt will become statute barred in 7 months. First thing I'm thinking is request an SAR to compare and contrast, is it too late for that?

time)

this sounds like they are very aware that this will soon be statute barred so are attempting to get it into court before that happens

definitely send a SAR as soon as possible

did they send you a copy of an OFFICIAL default notice ?

the 'agreement' sounds a bit dodgy too, sounds like they have tried to piece something together.

for now send a SAR asap to the original creditor and let me know if you have a compliant default notice

No, I have no copy of an official default notice. SAR has been sent. I agree also on how the "agreement" looks dodgy as hell.

what i would do is send off the SAR and wait until their solicitor contacts you and go from there.
