Intrum

Dear Community
I am helping a friend- he had a biz loan with RBS which he set up a payment plan with for a year but then they sold onto Intrum who have askedMoorcroft to collect.
Do we do the 3 letters to both Intrum and Moorcroft or just Intrum?
Also should we get a SAR from RBS

Hello again,

What’s a “biz” loan?

You would only write to Moorcoft (should be LESScroft...).

You will find that LESScroft send you the same response over and over (and over), I kid you not. They never bother to reply to any of your points. They are truly one of the most ineffective of the (entirely) ineffective DCAs I have come across, so it will be a walk in the park with them!

And yes, the SAR goes to RBS (even bigger aholes than LESScroft)

Is the business still operating? Was/is it a limited company or sole trader?

It was Ltd and was an overdraft
company does not operate now

Ok, thats good. Was company wound up go bust or is it just dormant?
Did he/she give any personal guaranties regarding this OD ?

went bust Daveiron - he cant remember - RBS wrote to him personally so I presume so

Ok , He needs to send an SAR to RBS , if there was a personal guarentee
it will be there ,if not its the company debt and now has nothing to do with him.

I assume that the overdraft account was in the company name ?

and intrum ( who will have no idea whatsoever ) will be chasing him personally

without a personal guarantee he is not liable.

in my opinion he needs to reply to intrum telling them the debt has nothing to do with him.

the wording on the notice of assignment may reveal what intrum think they have bought.
