If I have correctly understood the New v Old letter system, the new letter principle is repeated three times asking a DC to verify with the following, three times only?

I will conditionally accept your offer to communicate with you upon: -
(1) Your written agreement that you will sign all correspondence with a wet ink signature and the name of who signed it.
(2) You confirming that you have first hand knowledge of the matter.
(3) You confirming that you have performed due diligence in this matter.

Do we no longer use Notice to Agent is Notice to Principal?
Do we no longer send a letter with intention to ESTOP?
Do we no longer send a Notice of Acquiescence?

Sorry, I have been reading as much as I can but having used the old system, I wonder which would be effective?

BB

Hi the templates for both old & new are there. However there is a new
method called Notice of Conditional Acceptance, take a look at it and the
links provided with it and start your own research. It should stop any court
action as you will not be refusing to pay. Its working great for me & i gather
for others as well.
The trend here and elsewhere is to help people learn and not rely on templates
as they will do them no good.
I believe the 3 letter system is losing its former effect because people are
just accepting whatever docs the alledged creditor sends them and totally
fail to demand the ones they have not supplied. Sadly its a template culture
we all need to get away from.

Hi daveiron,

Thank you for your response.
Isnt the Notice of Conditional Acceptance used for OC or for purchased debt collectors only?

They can be used for both but its preferable to wait until the alleged debt
has been sold, however on occasions HSBC do not sell on but try to collect
themselves so a little tweeking will be required.Personally i prefer them for
debt purchasers
NoCA can be used for many things , We will of course give guidance to those who
are prepared to put in a little effort ,as to just copy & paste does you no favors

Old or New 3 letters to a DCA Empty Re: Old or New 3 letters to a DCA

Good morning,
Having researched further I can see the strength to the new process.
I am concerned about asking for an affradavit to be witnessed by a local solicitor and the costs involved, let alone the embarrassment of he/she being asked to do several affradavit witness signatures.
May I ask what others have paid per doc please?
Any advice gratefully received.

An affidavit ,its preferable if witnessed by a notary. However in the
absence of a notary 'two good men will suffice'

That is what i have done personally and the result has been total
silence from the DP for months since.

Thanks Daveiron.

May I ask, would you send an affradavit in immediate succession to the 3 x NOCA or wait until they either go the court route/ intimidation etc?

Yes i would after 10 days from the 3rd notice .
Look at Notice 3 in the templates ,its in the form of an affidavit
( it would have been better if it was notice 4 ,if the notices 1,2,3
were the same).my error but not important.

The final notice in the form of an affidavit should be all thats needed
to stop them. From that point an affidavit must be rebutted point by point
and in substance by them otherwise it stands at law,
They cannot or will not rebut it as to do so will expose the fraud.

This is what the NEW GOODF approach implies (we don't ask you to wait until they either go the court route/ intimidation etc)
