I've been looking closely into my mortgage and in particularly the validity of whether the mortgage I have is completely fraudulent.

In this regard I've been looking at the TGBMS video and the other web pages to get a handle on this and review my own documents.

I have obtained a copy of my Mortgage Deed. At the time myself and my partner signed the Deed, in the absence of our signatures being witnessed, and the form was sent back to my mortgage company.

Surprise, surprise the copy I now have includes the signatures and details of 2 witnesses and addresses which are now added to the form.

However, it states at the top of the form "DO NOT DATE", which of course we didn't, and it is still not dated!!

I'm obviously a novice in these matters, but am I right in saying that this should have been dated?

I've got a draft 'Notice' with questions to send to my Mortgage Company, but does anyone on here have any draft documents to assist that I can possibly use to help me with my possible fraudulent mortgage? Are there any more documents I need to look at?

Any help would be great.

Be careful with mortgages ,whilst what you have posted is correct.
Mortgages are a big cash cow for them and its something they will
fight all the way to retain.
A good place to look is 'You and your Cash.com' although i'm not sure
what info is available to non or new members. There are seminars & courses
there ,but i cannot recall the costs.

Thanks for getting back to me.

Just been watching the videos on youandyourcash.com. Haven't looked into doing it this way, but it looks very expensive entering into an agreement with them where I would have to pay 25% of any benefit they would receive if I was successful.

As above, I'm looking into raising questions by way of a Notice. Would this affect my mortgage? I've not defaulted in any way and am still making payments.

Does anyone have any experience of dealing with Mortgage Companies by way of Notices?

I wouldn't touch that with a bargepole.  It sounds like one of these scams where they get you to claim back DD payments, you pay them 25% of the money you've recovered - but then you find you're being pursued for the whole amount, plus costs etc.

Remember that in the (frankly unlikely) event that you can get the mortgage deed set aside and the charge removed, this does not cancel the actual loan which is still outstanding.  The guy behind TGBMS found this out for himself. In his case the deed truly was invalid because there was no attestation at all, but the court while setting it aside simply ordered a new and valid deed to be signed.

Yep, as I say, sounds very expensive.

The thing is, whilst the Banksters say it's a loan, the system works with you signing what is essentially a promissory note which is not a loan agreement. This means that whatever the alleged loan is, you've paid it off already with the promissory note, and the Banksters than ask you to pay it all over again, with interest!!!

I need to do some more research.
