If I receive a letter stating that they are gaining requested documentation from the OC and either put it on hold or give a date it's on hold until, do you continue with letter process or await the outcome?

Up to you, personally i would carry on. They should not have claimed you
owe them money without any proof of claim whatsoever.

It just shows many accept their BS.

We often overlook the obvious when we are requesting documents and submitting DSAR's to the debt buyers, as well as not absorbing the content of 'legal' documents we have received.

to try and explain : when a 'debt' is allegedly 'sold' you will receive notice of the alleged assignment, you should receive 2 of these 1 from the OC and 1 from the DB now in almost ALL instances the one from the DB will state that they are using another company to collect on their behalf it may be part of the same group or the name will be almost identical to the actual buyer however a different company with a different co. No. registered with companies house.

why is this ? well often the actual buying company is NOT authorised by the FCA !? they and only they can issue a claim as the alleged creditor so what is going on here ? ( the answer to that is hidden deep within how it all works ) it is an arguable point and a winner but unfortunately Judges ignore, bypass or 'get around' it, but this should be checked at the beginning and questions asked.

at some point along the way why not ask the question " who gave you permission to share my data with another party" because that is what they are doing, also if the company writing to you are the 'buyers' agent in reply to your DSAR asking you to provide passport driving licence etc what the hell are they doing asking for personal information ? they have nothing to do with the account try it and see what comes back.

another point these DB notices very often state that we are now data controller of your data in respect of this account yet when you ask for an item of evidence they dont have your dat ? they have to go back to the OC to try and get it ?? so how much data are they claiming to actually be in control of ? if they have nothing in the way of requested documents ??

again another question to ask them

ask in writing for all of these things many trip themselves up and get it wrong and then give another reason to what they have already given, all good arguments against them should they want to go to court.

Moral is : read and understand what is written in their letters success is often right in front of you but is overlooked
