BW Legal - Country Court Claim

Hi, I didn't know that the original site has been sold on to a debt management company? Shame....

Anyways, Today I received a letter from "BW Legal" who are acting on behalf of "PARC Financial LTD" who in turn are acting on behalf of "Instant Cash Loans T/A PayDay UK" - Please note this is the first instance of any letters I have ever received from BW Legal.

The letter reads:
"We have been instructed by PRAC Financial Limited to commence legal action in the form of issuing a Claim against you in the County Court, without further notice, in respect of the above debt, if payment or a response is not received before 28 November 2017. If you dispute this debt, please tell us why so that we can help resolve this matter."

They then estimate that once the debt is added up with court fees and interest i'll have a final debt of £181.99 to pay off if taken to court. It then reads the "Particulars of Debt" which reads:

On 30 October 2011 you entered into an agreement with Instant Cash Loans Ltd t/a Payday UK to provide you with a account. You failed to make payment in accordance with the terms of the agreement and it was later terminated and has since been assigned to Our Client on 9 December 2016. Notice of this assignment has been previously given to you. Despite Our Client's attempts to engage with you and agree a suitable payment arrangement, there is a Balance which remains unpaid."

If i'm not mistaken this debt has been chased Looooooooong before Dec 2016. Not only that but 30 Oct is 3 days away, in 3 days time isn't the account Statute Barred? Any advice on what I can do next is much helpful, I was thinking of just biting the bullet and paying the £100 debt off, but then they have won then, and I never want to see bullies win!!

HI lehart

It will be statute barred 6 years after the default notice , not when you started the agreement,
you can start with the new 3 letters acting as agents,

if it just £100 up to you how you feel

Hi Lehart
I received an identical letter last Friday as well.
The only difference between our letters is the alleged amount (£375) and the alleged agreement date (26.01.2012).
I wonder if they have just sent out a mass "flyer" just to see who they can intimidate?
PRAC have never sent any details of the alleged agreement.
Have sent an s.78 request to PRAC
