Hi there

I've received 2 x Claim Form from the above company - Claimant is Hoist Portfolio Holding Ltd and Correspondence details is Howard Cohen & Co - it is a proper CCJ form from Northampton.

The amounts are £400 ish and £1400 ish for each claim including costs.

These debts go back to 2008/2009 and I had obviously mistakingly thought they were settled and completed - however clearly not and now I've got these.

I am tempted to object but I don't really want CCJs - my question is - is it worth objecting? I've no idea who the original debt is actually with for starters. Would they settle for any less money if I contact them? I have some money from a relative which doesn't cover the debt in full but could pay a little over half if they were willing?

Just not sure whether I'd be wasting my time objecting to it and just end up having to pay it all or more!

It's making me really anxious thinking about it so I don't want it dragging on but at the same time I don't want to pay a debt I don't know where it has come from.

Hope that makes sense and thank you for any help.

What were these alleged debts for, what were the last payment dates, have you had any contact from anyone since
2008/9 ?

I don't know what they are for directly - I suspect as the letter says ex HSBC further down that they are a credit card and overdraft formerly with them. We were making payments with Payplan until last year and since we stopped them we have had letters from Robinson Way and then this.....I realise I might not have a leg to stand on but I would prefer to come to a deal with them if possible or fight it - I have no clue the amount of the whole original debt.

Further down it says that the debt was legally assigned by IDEM Capital Securities Ltd (Ex HSBC).

I mainly want to avoid a CCJ but don't have the funds to pay in full so that is my issue.

Unfortunately I believe you have left it far too late now. As you have been paying these debts it means you acknowledge you owe them.
Wait for other advice but the best I can suggest is that you write to them & tell them that in any event you will only be able to afford very low monthly repayments.However you may be able to borrow enough should they be willing to accept ( 50% or whatever you think you can afford, I would not offer more.) In full and final settlement.
Do not mention that you are trying to avoid a ccj .or they are likely to try for the whole amount.

Remember they only paid pence in the pound for these accounts & 50% now is far better for them than repayments made over perhaps years.

Yeah I don't really dispute that I owe them - i just have no idea where they originate really. I just want to try and settle them without getting a CCJ - I'm glad that they might negotiate. Thanks for your help.

Be careful here because they have already issued a claim against you so you have 14 days to respond to the claim form else you will get 2 x CCJ's against your name by default.

I dont understand that you dont know what these are for ?? surely they must have been writing to you for weeks if not months now ?

you must make a very quick decision, are you going to defend the claim ?

Also you had the perfect opportunity to ask for proof of what these were about when they sent you the pre action letters !?
