Hello all,

EDF have been contacting me since October asking OCCUPIER to pay them. I've never contacted them. Previously the OCCUPIER was with Igloo but they went bust. I moved into the house in July so I never contacted them. So I do not have a contract with either, neither does OCCUPIER.

Igloo have written to OCCUPIER but since then a debt collection agency have contacted OCCUPIER asking them to pay up. As they don't have my name, I have not contacted them, neither has OCCUPIER. If they did then I would dispute it as Igloo should not have passed on OCCUPIERs details.

Similarly EDF have just written to OCCUPIER telling OCCUPIER that they will be passing details to another debt collection agency. Of course OCCUPIER is not me so I don't think I should be contacting them. They have no idea how much gas/electric has been used by Occupier but are just plucking numbers out the air. But should OCCUPIER contact them? for all they know noone is OCCUPYING the property and no gas/electric is being used an noone is getting their letters.

Occupier could write a notice to them, DSAR or NCA but that would give the game away that someone is occupier and they may try to pursue him/her

What do you think?

just to be clear is the property under dual or single fuel bills? - single meaning 2x 'suppliers', 1 each. I know it sounds confusing but a dual fuel supplier is 1 for both supplies. Does 1 company have a claim on gas alone? That would be a single supplier.

To the OCCUPIER, this has always been tricky for most to get thier heads around but, it means as you state THEY don't know which NAME is at the property. THEY will have a 'deemed' contract under gas & leccy legislation - ie the 'registered meter' at the property may be of benificial use to the 'OCCUPIER', but its say EDF or Igloo being registered supplier at the address of ??? that will have the 'contract' - meaning THEY will 'own' the meter & have a right to exercise through entitlement (statute/acts & send bills).

The choice is difficult for you on 1 hand you don't (quite rightly) want to establish joinder - form contract. But on the other if something is NOT done by you ultimatly THEY will go for a warrant to either cap the supply as no one is answering letters (assume property is empty), or fit pre pay as an aledged outstanding debt has not been 'paid'.

DSAR/FOI etc are a waste of time because THEY cannot process data in the name of 'OCCUPIER' unless you b'cert name is 'OCCUPIER'.

Doing nowt is NOT really an option but its up to you.

Here is food for thought, s/he who controls the meter controls the supply. Have a think?

each time a 'supplier' is changed the legal 'title' - owner changes also, as per my last post should be: s/he who 'owns' the meter controls the supply.

this is NOT something I have tried, I don't really recommend it, why? because I know how these courts & suppliers are completely corrupt & you will get railroaded, but its up to you.

I do completely agree though it should work, if these people were honest, which they are far from.

Can they apply for warrant of entry for OCCUPIER?
How does the DEEMED contract work. Just because they have their meters in there then they can send letters? I guess that means it would be worth changing the meters to my own...

Yes but its fraught with the same ideas & reality as with discharge by endorsement - courts, turning up to fit pre-pay, kick front door in, etc

Does removing the meters actually work. I bet the parasites still send notices and demands or try to gain entry and once they know you changed the meters they will take another fraudulent action?
