Hi Andybreck

If you got a claim form from the county court , fill it in and send it back you have 14 days best do it on line , or you will get a ccj , this will give you more time to look into it
a friend of mine got a claim form for the same thing , just before court day he got a letter saying they pulled out

i was not driving at the time of the incident due to illness. i
will need photographic evidence of the driver due to there being
five other possible drivers.

just a quick update civil enforcement limited had 28 days to reply after receipt of my defence its now been 32 days and they have been no contact.so now they will have to apply to a judge for an order lifting the stay if they want to take further action

If a "Judge" does order, you know they're only a Judge if they're acting under their Judicial oath, otherwise you can get the order void. still learning, but think I'm right

got home today and a claim form was there from civil enforcement ltd for parking on the same car park but different date Evil or Very Mad i need to tell the people who drive my car to pay for the parking Wink

With penalty charge notices initially they write to the registered keeper, then the owner, they only assume the registered keeper is the owner, its up to the registered keeper to prove otherwise. It is the owner who is liable, not the driver or registered keeper. You can prove that someone else owns the vehicle by a declaration of trust, i.e you are the beneficiary they are legal owner, then they have to go to them for the money. I havre a friend in Indonesia, it'd difficult for them to track people aboard.

One problem here Waffle, if you register a vehicle you transfer ownership to the DVLA as soon as you register it.

If you deregister a vehicle and then put it into trust then it becomes the property of the trust.

That idea is great assassin, but if it is not registered and we're using it on the road it causes problems, they do not hesitate investigating the situation, know your rights and you might be ok, but still is it worth all the agro??

A point worth making, if it is not registered can you still insure it, tax it and get an MOT? If you can do all of this, i.e running the vehicle legitimately without registering it or by deregistering it (i don't know if SWORN counts for this) without having to deal with the agro it may be worth while, in my opinion anyways.

The DVLA just maintain the register for someone else, like the GRO....
