Good evening members Wink

I`m helping someone who has received a CCBC claim form for an alledgrd £3500 debt which lowell purchased.

We have completed the MCOL acknowledgement and sent a £1 postal order off to lowells for a true copy of the Credi Agreement.

Also sent a CPR18 Request to Cohen solicitors ........ copy also sent to MCOL marked "for imformation purposes only" - just to update the files.

Below is the reply received:

Cant recall reading a reply similar to this before; is there some further action we should take?

i would recommend a SAR to the original creditor

is the request for a copy of the agreement an official CCA request?

and of course you must file a defence to the claim.

SAR on its way today & yes the CCA request is an official one.

Compiling the Defence now - is it to sign it and upload the finished document to the MCOL case files?

Do we need to do anything else or sit and wait to see what lowells/cohen reply with?

it would appear that your friend would have received a letter before action and did not respond to this ?

if this is the case then it could go against them ( slightly).

what i would do is to send a further request for documents in a letter under CPR31, depending on what it states in their particulars of claim.

you will likely get a response that CPR31 doesnt apply etc etc and that you should have responded to the letter before action ( which is true to a degree)

dont be too hasty with submitting a defence, make sure that you acknowledge the claim form straight away but use the time wisely before submitting a defence.

this all depends on the date of the claim.

just my own thoughts on this.
