Hi

I've sent the 3 new letters to UKSearch and they've come back
with this:

1. There is no agreement as per the Water Charges Pursuant to the Water Industry 1991.
2. There is no contract as the debt is for Utilities this is a Deemed Contract, which means that when you become liable for a property you also become liable for any utility bills until you the customer change supplier, however as this is a water debt, currently you do not have any choice to change supplier.
3. There is no signed statememt as this is a deemed contract ( details are above).
4.There is no signed statement as we are not in possession of the original agreement, as there is no agreement as this is a deemed agreement (details above)
5.There is no original agreement as this is a deemed contact.

I must make you aware UK Search do not accept your terms and conditions of your charges.

This is UK Search full and final response to this matter.


I am already paying them monthly for one account that I didn't send the three letters
for.
Another account they returned to Southern Water after I sent the new 3 letters.
Now they claim I owe the latest water bill plus it looks like what they say I owed before.
Would appreciate any help as I'm struggling especially during these times.

Perhaps others (possibly Mods) would reply to this as from my experience the 3 letters were NOT (I think) meant for this.

for more info on this. To help you a little. I have had that, there is no contract or agreement to supply you with water. If you read the threads on A4V & follow some of the links you will see that would appear to be true.

I am NOT trying to encourage you to do A4V as that would probably make things more difficult than they already are, just trying to give you the opportunity to get information as to why they state what they do.

The information I gathered whilst researching A4V lead me to this conclusion of no contract or agreement. But the way good honrable discharge is given for water can be found there.

If by entering a payment plan is the best way for you to go then go for it & I hope all is well for you.

BTW there can be NO deemed contract as the case (Ithink) of Beavis v Parking Eye, 1 judge in the summing up stated to the effect "you cannot have a deemed contract, you either have a contract or you don't".

As you are struggling I don't really know what to suggest apart from entering a payment plan except there was something in the utilities form give me some time.

Have had a look at the links and don't think I qualify for any help there, will keep on reading.
I pay UkSearch £20 a month already and cannot afford more. Do I contact
them to tell them this? Would they put the debt together as one payment plan?
Not sure what to do.

If £20 is ALL you can afford then tell them £20 & NO more (forming contract) - the offer. This is important, as to what they will do with the plan I cannot say as I am not in charge of it.

If they do threaten court then when submitting evidence to the court I don't think anything over & above what you have stated can be enforced or put on to you, why? Its like saying "I want this car that will only do 50mph I want it to do 100mph", if all it will do is 50 then how can it be forced to 100, does not make sense does it?

As £20 is all you can afford any court should look favourably on you because offering that, the water should/will have to accept it because its all you can afford.

Thats all I have, others on here may offer different or a variation on what I have stated.

Always contact by letter, & never by fone as you need all down in writing. Hopefully it will NOT get to court but should it get that far at least you are well versed - informed.

You could try:

As its all I can afford what makes you think I can give more? If you want court action do it, if the court awards you more, if I cannot give more then what more do you think you are going to get?

Amazing isn't it, I have to distill all my water to make it drinkable. I also give them a good resource
down the toilet that I pay for and they sell it to farmers to put on the fields without processing it properly.
Look at The Big Necessity by Rose George an excellent read.

Does anyone have any other ideas how to deal with these water companys?
