debt settlement payoff
Hi, I have a debt with a collector and pay £20 a month, I want to clear the debt and wanted to know what's the best thing to do.
Do I offer them a certain amount, half for example? Thanks!

Thanks for replying.
I've been paying them £20 a month for a while, the letters did work for
a long time though I missed one and that was it, didn't want to risk court,
it was for a water company.
Is it worth offering half or is 75% more like it, many thanks!

Re: debt settlement payoff
Just my opinion but I think you'd be looking at less than 50%. And it would need to be accepted as full payment, any debt classed as fully satisfied and not in default.
Is it a debt collection agent acting for the original creditor, or has the (alleged) Debt been sold or assigned?

Re: debt settlement payoff
Thanks, it's a debt collector for a water company, is there a template letter to send for making an offer?
They are acting for the original creditor
I have one account with them I'm paying £20 and there is another account they remind
me of once in a while and that number has appeared on the water company bill as arrears.
I haven't set up a payment for the second account.
I was thinking of offering them money to pay off both but I'm not totally clear on
how to do it.

Re: debt settlement payoff
Personally i would only deal with the water company.
Just write and make an offer in full and final settlement on the alleged debt.

Is there a template for the full and final settlement, not sure what to offer them,
I was thinking 50% of the debt, is this too much/ too little?

Re: debt settlement payoff
Template not needed, Personally i would try 30%-40% ,which you should
tell them you would need to borrow.
You can say that maintaining the present arrangement will not be possible
and you could only afford ,say £5. payments

By contacting them and making an offer you are accepting liability for the debt and offering to cure.

Hi, I 've written to Southern Water with a full and final settlement offer.
They said we understand you are facing difficulties paying and can
contact our Affordability team.
Any one got any ideas, thanks!

Re: debt settlement payoff
Its up to you, you have offered to settle ,the rest is up to them.
If it were me i would write to SW ,tell them you have made a one time offer,
and if its not accepted you will only be making a payment of £5.00 per month
as its all you can afford.

final
Hi I've made a final settlement offer to Southern Water, they keep
replying saying to call the affordability team. This has been going
back and forth, would it be best to offer the collector a final offer?
Thanks

Re: debt settlement payoff
I don't there would be any harm in restating your offer to SW. There might be some benefit in addressing or copying it to the "affordability team". Then if it's ever necessary to speak to the DCA you can tell them you're in discussion with SW.

Re: debt settlement payoff
Write to the CEO personally (recorded delivery) Inform him/her that
you have offered remedy x times and the recipient has failed to address
the issue.
Give them 10 days to address the matter otherwise they agree that
there is no longer an alleged debt.

Re: debt settlement payoff
I've written to the CEO of Southern Water saying I have offered remedy 3 times
with no response, I gave him 10 days to reply.
The debt collector has now sent a Letter Before Court, I've replied to them that
I'm in contact with the CEO.
Is there anything I can do here? I have a feeling neither will respond and they'll
just bully me into paying in full or court.

Re: debt settlement payoff
A debt collector can't take legal action, are you sure the debt hasn't been purchased? Legal action can only be taken by the actual creditor or by a solicitor acting for the creditor.
Just looking at the worst case, if it doesn't come to legal action there is a stage for mediation, at that point you'd restate your offer pointing out that you have tried to discuss this with the "affordability team" as advised, with no response.
Are you still paying the £20 which I presume was an arrangement they're originally agreed? If so I can't see that anyone would have grounds for a court case anyway.

Re: debt settlement payoff
ward hadaway have been instructed by uksearch who are the litigation agents of Southern Water if I don't pay in full or arrange suitable payment. I just want
rid of it now but would rather not pay the full wack as it's quite a lot, I kept
them off for years. Yes simple steps as to what would be the best thing to do would
be much appreciated, thanks once again!

Re: debt settlement payoff
Stand your ground, You have offered remedy 3 times. Also the ceo has failed to rebut your offer.
What are they going to tell the judge ? 'The defendant has offered remedy 3 times & we failed to respond along
with the ceo failing to rebut the offer'
